1. The instant application has been filed by the applicant under Section 378(4) of the Code of Criminal Procedure (for short ‘Cr.P.C.’) seeking grant of leave to file appeal against the judgment of acquittal dated 05.10.2016, passed by the Court of learned Chief Judicial Magistrate, Ferozepur in Criminal Complaint bearing No.90 of 2009 titled as 'Sohan Vs. Sohan and others', filed under Sections 323, 325, 326, 452, 506, 34 IPC, whereby respondents/accused had been acquitted for commission of aforementioned offence.

2. Today, the case was fixed for addressing arguments on the application. Learned counsel for the applicant, while relying upon a recent pronouncement of Hon’ble Supreme Court in M/s.
