1. Through the instant petition, filed under Article 226/227 of the Constitution of India, the petitioner, has approached this Court, seeking quashing of the result, which was declared by respondent no.1, on dated 13.11.2024 (Annexure P-8), whereby, respondent no.2, was selected to the post of Process Server in general category, whereas only three posts were advertised for general category candidates, and one post of general (sportsman), and rest posts for other reserved category.
2. Learned counsel for the petitioner submits that only three posts were advertised for general category, whereas, one post was reserved for general category (sportsman). However, against the reserved post of general category (sportsman), respondent no.2, has been appointed, being a general category candidate.
3. At the outset, this Court, in order to resolve the issue, vide order dated 30.01.2026, directed learned counsel for respondent no.1, to place on record the application forms submitted by the petitioner, so as to find out, under which category the petitioner had applied for.
4. In deference to direction (supra), learned counsel for the respondents, has placed on record the two application forms, as submitted by the petitioner, which are annexed as Annexure A-1 and A-2. Both the applications clearly reflects that the petitioner had applied under general category. Therefore, once the petitioner had applied under general category, he cannot raise a grievance, that he was required to be considered under general category (sportsman). He further submits that though the respondents considering the sports documents attached with the application forms, evaluated the candidature under the sportsman category, however, they found him, no suitable.
5. As per the conditions, the Note:3 of the advertisement (Annexure P-1), the posts of reserved category will be offered to the candidate of general category, in case no suitable candidate from the reserved category is found available. Even on this parameters also, since the candidature of the petitioner was not found suitable under the general category (sportsman), the said post was offered to the general category candidate. 6. In view of the above, the instant petition, is hereby, dismissed, being devoid of any merits.
7. All pending application(s), if any, also stand disposed of accordingly.
