1. The present petition has been filed under Article 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for setting aside the impugned proceedings of the meeting dated 21.11.2025 (Annexure P- 8) and also proceedings of no-confidence motion and appointment of new President i.e. respondent no.9 vide proceedings dated 08.12.2025 (Annexure P- 10 & P-11) with a further prayer seeking issuance of a writ in the nature of mandamus directing the respondents to reinstate the earlier Society headed by its President as per the order dated 20.11.2025 (Annexure P-6) and to allow them to work for its day to day business in a democratic manner.

Mr. Pawan Kumar, learned Senior counsel appearing on behalf of the petitioners assisted by Ms. Vidushi Kumar, Advocate submitted that the petitioners are the members of respondent No.6-Sanghera Multipurpose Cooperative Agriculture Service Society Limited, Sanghera and petitioner No.2, namely, Gurmail Singh is the President of the Society. He further submitted that a meeting was conducted on 08.12.2025 with regard to some Agenda purported to be circulated vide Annexure P-8 and the entire meeting was hijacked by respondent No.9 along with his associates in connivance with the officers of the Cooperative Department. He further submitted that at the time of meeting when ‘No-motion Confidence’ was presented against petitioner No.2, no member was present except for petitioner No.2, namely, Gurmail Singh although some of the members were present in the morning but no such meeting had actually taken place and the entire record of the Society was forcibly taken by respondents No.7 and 9 in their own custody. He submitted that the aforesaid meeting could not have been conducted in absence of the official members. In this regard, he referred to Annexure P-10, which is purported to be Minutes of the Meeting wherein it has been so recorded that 8 out of 11 members have signed the same whereas in fact on that day, one of the members, namely, Swarnjit Kaur was admitted in a hospital at Bathinda and she underwent a spinal cord surgery and the other members were also not present on that day. He further submitted that the aforesaid Minutes of Meeting which was purported to have been conducted in which ‘No-motion Confidence’
was passed against petitioner No.2, are all fabricated.

Learned Senior Counsel further submitted that specific allegations have been made in Para Nos.18, 19 and 20 of the present petition wherein it has been specifically mentioned that the proceeding book/register was taken away by respondent No.9 and the aforesaid meeting was conducted in a mala fide manner in connivance with the local politicians. He also submitted that rather a video was made by them which was supplied to the Assistant Registrar, Cooperative Societies and along with that video, a separate representation/complaint was also given to the Assistant Registrar, Cooperative Societies but he never accepted the same and refused to acknowledge the complaint/representation. However, the petitioners thereafter sent a representation/complaint (Annexure P-17) through WhatsApp to the Assistant Registrar, Cooperative Societies, against whom also, the allegations of mala fide have been levelled by the petitioners in the present petition. Still, no action was taken by him on the issue of hijacking of the entire election process.
