1. The present is a petition filed under Section 11 (6) of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as ‘the Act’), seeking appointment of an arbitrator in the present case.
2. Learned counsel for the petitioner prays for deletion of name of respondent No.2 from the array of parties on the ground that he has expired. 3. On the oral request made by learned counsel for the petitioner, the name of respondent No.2 is ordered to be deleted from the array of parties.
4. Registry is directed to carry out the necessary correction(s) in the memo of parties.
5. Learned counsel for the petitioner submitted that a loan agreement was executed between the parties, which contains an arbitration clause at Clause 10.8 and the said agreement has been appended with the present petition as Annexure A-2. He further submitted that since a
