1. In the present petition, the challenge is to the impugned order dated 20.07.2021 (Annexure P-3) passed by respondent No.2 – Armed Forces Tribunal, Regional Bench, Chandigarh (hereinafter referred to as ‘the Tribunal), by which, respondent No.1 has been held entitled to the benefit of ordinary family pension.

Learned counsel for the petitioners submits that since the husband of respondent No.1 was not in receipt of any pension, the grant of benefit of ordinary family pension to respondent No.1, by treating husband of respondent No.1 as eligible for grant of disability pension, is incorrect.
