1. Present third petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the petitioner in case FIR No.293 dated 12.9.2020 under Sections 302, 323, 324 and 34 of the IPC, registered at Police Station Basti Bawa Khel, District Jalanahdar.

2. The case set up in the FIR in question (as set out in the present petition by the petitioner) is as follows:-

‘Statement of one Roshni wife Ravi Kumar, daughter of Gara Ram, resident of Shiv Nagar near Dogra Ladri, Police Station Division No. 1, Jalandhar, age about 20-21 years, stated that I am a resident of the above address and do domestic work. My father Gara Ram, son of Thoru Ram, was working in the Punjab Home Guard, whose duty was at Gandhi Vanita Ashram, Jalandhar. I got married on 12-03-2020 to Ravi Kumar, son of Ramesh Lal alias Pappu, resident of Street No. 16, Guru Ram Das Nagar, Police Station Division No. 1, Jalandhar. On the second day of my marriage, my in-laws started taunting me for bringing less dowry and asked me to bring three lakh rupees. Within two months of my marriage, I was beaten up four or five times and on 29-05-2020, my husband Ravi Kumar, brother-in-law and father-in-law Ramesh Lal beat me up a lot due to which I suffered severe injuries on my body, arm and head. In this regard, my father had filed an application at the Women's Cell Police Station, Jalandhar, on which case number 40 dated 21-08-2020 US 406,489-A,323 IPC was registered at the Women's Cell Police Station, Jalandhar. My husband Ravi Kumar had filed his anticipatory bail application in the Hon'ble Sessions Court, which was rejected. From that day on, my husband Ravi Kumar was threatening to kill me and my father. Today, on 12-09-2020, at around 4/4.30 PM, I was going to the market with my aunt's son Sunny S/O Tony Pandit to buy household goods. When we reached Mand Palace, we saw that my father, who is about 52 years old, along with my husband Ravi Kumar and his brother and other associates were beating my father. My husband Ravi was holding a sharp knife in his hand, and in front of us, he stabbed my father on the chest and face, due to which my father fell on the ground and a lot of blood came out of his body and fell on the ground. We shouted, "Killed him, killed him." Then, seeing other people gathering, my husband stabbed my father in the chest with his hand and left his motorcycle, number PB08 CG 3869, Splendor and fled the scene along with his accomplices. My father died on the spot due to excessive bleeding. The reason is that my husband's bail application was rejected by the Honorable Court, so he and his accomplices killed my father. 3. Learned counsel for the petitioner has argued that the petitioner is in custody since 13.9.2020. Learned counsel has further argued that the petitioner has been falsely implicated into the FIR in question as he was having a matrimonial dispute with his wife-Roshni (FIR-complainant), who is the daughter of the deceased. Learned counsel has further submitted that the petitioner has suffered incarceration for more than 5 years. Learned counsel has further submitted that the trial is procrastinating and folly thereof is not attributable to the petitioner as one PW Sunny Kumar is not coming up despite repeatedly bailable warrants issued against him.
