1. This is an application filed under Section 5 of the Limitation Act for condonation of delay of 333 days in filing the present review application.

2. For the reasons stated in the application which is duly supported by an affidavit, the present application is allowed and delay of

333 days in filing the present review application is condoned.

RA-RS-57-2025

1. This is a review application filed under Order XLVII Rule 1 read with Section 114 and 151 of CPC for review of order dated 03.09.2024.

2. On 21.01.2026, this Court had passed the following order:-

“Present: Mr. Sandeep Singh, Assistant Advocate General, Punjab. for the applicant-appellants.

Since none had appeared on behalf of the respondent on

03.09.2024, this Court was pleased to pass the following order:

1.Learned counsel for the appellants has submitted that in the present case, respondent has retired and in all probabilities, nothing survives in the present appeal and has prayed that the present appeal be disposed of as having been rendered infructuous but liberty be granted to the appellants to revive the case, if any cause survives.

2. In view of the above, the present appeal is disposed of as having been rendered infructuous. However, liberty is granted to the appellants to revive the case, if any cause survives.

3. Registry is directed to send copy of present order to the parties, on the addresses mentioned in the memo of parties.

4. A photocopy of this order be placed in the file of the connected case.”

On 25.09.2025, notice was issued in the review application as it was the case of the appellant that the respondent had filed execution, although no one was appearing on his behalf before this Court. The said review application is now listed on 17.02.2026.

Learned counsel for the State has submitted that the respondent has filed the execution and the next date before the Executing Court is 31.01.2026. It is further pointed out that when the matter was admitted, the stay order in favour of the State was ordered to be continued.

Notice in both the applications for 17.02.2026.

To be taken up immediately after the urgent list.

The Executing Court is directed to give date beyond the date fixed before this Court.

January 21st, 2026”

3. Mr. Sushil Saini, Advocate has appeared on behalf of the respondent and has submitted that he would argue the matter on the date fixed by this Court.

4. Keeping in view the abovesaid facts and circumstances and averments made in the review application, the same is allowed and order dated 03.09.2024 is recalled and the main appeal is restored to its original number and is taken on Board today itself.
