1. The present civil revision petition has been filed under Article 227 of the Constitution of India for setting aside the order dated 15.12.2025 (Annexure P-4) passed by the learned Civil Judge (Jr. Divn.), Abohar in Civil Suit No. CS No. 905 of 2021 titled Shiv Narain Bhadoo Vs. Mahavir Bhadoo (now deceased) through his legal heirs, whereby the evidence of the petitioner–plaintiff was closed by order of the Court.

Briefly stated, the petitioner–plaintiff Shiv Narain Bhadoo instituted a suit for declaration to the effect that he is owner in possession of the suit property as detailed in the plaint, along with consequential relief of permanent injunction restraining the respondents–defendants from interfering in his peaceful possession over the suit property. Upon notice, defendant No. 1(A) and defendant No. 5 appeared through counsel and filed their written statement. On the basis of the pleadings, issues were framed and the matter was thereafter fixed for evidence of the petitioner–plaintiff.

3. A perusal of the impugned order dated 15.12.2025 reveals that several opportunities, including a last opportunity, were granted to the petitioner–plaintiff to conclude his evidence. However, on failure to do so, the learned trial Court ordered closure of the plaintiff’s evidence by Court order.

4. Learned counsel for the petitioner submits that valuable rights of the petitioner are involved in the lis and prays that one effective opportunity be granted to conclude the entire evidence, in the interest of justice.

5. In view of the nature of the order proposed to be passed, issuance of notice to the respondents is dispensed with, as the same would unnecessarily delay the proceedings and entail additional expense.

6. I have heard learned counsel for the petitioner and have perused the record.

7. Having considered the submissions and the material available on record, this Court is of the considered view that, in order to ensure proper and effective adjudication of the controversy between the parties, the petitioner deserves one more effective opportunity to conclude his entire evidence. At the same time, the petitioner cannot be permitted to delay the proceedings any further without consequence.

8. Consequently, the present petition is allowed. The impugned order dated 15.12.2025 (Annexure P-4) passed by the learned Civil Judge (Jr. Divn.), Abohar is hereby set aside, subject to the petitioner depositing costs ₹

of 5,000/- with the District Legal Services Authority, Abohar, before the next date fixed before the trial Court.

The petitioner–plaintiff shall appear before the learned trial Court on the date already fixed or on a date to be fixed by the trial Court, and shall be granted one effective opportunity to conclude his entire evidence. It is made clear that no further opportunity shall be granted, and in case of default, the learned trial Court shall be at liberty to proceed in accordance with law.

10. The Registry is directed to forward a copy of this order to the learned Civil Judge (Jr. Divn.), Abohar for information and compliance.

11. All pending application(s), if any, shall stand disposed of accordingly.
