Petitioners/defendants are aggrieved by impugned order dated

18.11.2025 (Annexure P-1) passed by learned Civil Judge (Junior Division), Ludhiana, vide which their application under Order VII Rule 11 CPC was dismissed. Petitioners/defendants in their application under Order VII Rule 11 CPC had sought rejection of plaint, on the ground, that respondent/plaintiff has failed to disclose cause of action and that suit is barred by limitation.

2. It is asserted that since the stand taken by respondent/plaintiff is in violation of Prohibition of Benami Property Transactions Act, 1988, therefore, under Section 4 of the said Act no suit is maintainable with the Civil Courts, hence plaint is liable to be rejected on this ground also.
