1. Prayer in the present petition filed under Section 12 of the Contempt of Courts Act for initiation of proceedings for civil contempt for willful disobedience of the orders dated 30.07.2025, 22.08.2025 and 12.01.2026 passed by this Court in CRM-M-39630-2025 titled as Jugraj Singh @ Laddi Vs. Union of India for issuance of directions to ensure immediate medical examination, hospital admission and treatment of the petitioner.

Learned counsel for the petitioner has submitted that the petitioner is an under-trial prisoner and presently, lodged in Central Jail, Amritsar, Punjab in NCB Crime No.36/2024 dated 16.10.2024, under Sections 8, 21, 23 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. He has submitted that the petitioner has been complaining about his serious health condition which is deteriorating day- by-day because of chronic pulmonary disease and acute symptoms such as cough, weight loss, loss of appetite, night sweats. He has submitted that the petitioner is completely dependent on the jail administration for treatment. He has submitted that the petitioner has approached this Court by way of connected petition bearing CRM-M-39630-2025 for grant of regular bail wherein vide orders dated 30.07.2025 and 22.08.2025, this Court had also directed the Jail Authority to conduct a medical examination of the petitioner and provide necessary medical treatment as per the opinion of the doctors but despite the said orders, the jail authorities failed to comply these orders. He has further submitted that as the petitioner was suffering from ‘lung ailment’, this Court vide order dated 12.01.2026, again directed the Jail Authority to conduct medical examination of the petitioner and provide necessary medical treatment as per the opinion of the doctors. He submits that in pursuance to abovesaid order, the respondents have miserably failed as the petitioner has not been shifted/admitted for proper treatment and as such the respondents are liable to be punished for committing contempt of Court's order and thus, contempt proceedings be initiated against the erring respondents.

3. Per contra, learned State counsel has opposed the submissions made by counsel for the petitioner. He has submitted that in compliance of the orders dated 03.07.2025 and 22.08.2025, the petitioner was medically examined by the Jail Medical Officer and report was also prepared. He has also submitted that regarding the medical examination and report, status report dated 12.09.2025 has also been filed by respondent No.1 in CRM-M-39630-2025. He has further submitted that on 13.09.2025, the petitioner was referred to the TB and Chest Department of Guru Nanak Dev Hospital, Amritsar for medical treatment and since the condition of the petitioner was found to be stable, he was not admitted to the hospital. He has placed on record the short reply by way of an affidavit of Mr. Rajiv Kumar Arora, Superintendent, Central Jail, Amritsar wherein it has been mentioned that the petitioner has annexed tampered, forged and fabricated hospital documents, wherein it has been shown that the petitioner was required to be admitted to the hospital however, on 13.10.2025, petitioner never visited the Guru Nanak Dev Hospital for any medical check-up. He has further submitted that the orders passed by this Court have been duly complied with and as such, the present contempt petition be dismissed.
