1. The prayer in the present appeal is to set aside the judgment of conviction and order of sentence dated 04.08.2008 passed by learned Judge, Special Court, Jalandhar whereby the appellant was convicted and sentenced for the offence punishable under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as ‘NDPS Act’), in the case stemming from FIR No.92 dated 21.06.2004 registered under Section 21 of NDPS Act at Police Station Adampur, Jalandhar.

2. The appellant was sentenced for keeping in his possession 13 grams of smack, as mentioned below:

Offence Sentence
Section 21 of NDPS Act Rigorous imprisonment for a period of six months and to pay fine of Rs.500/- and in default of payment of fine, to further undergo RI for one month.
