KULDEEP TIWARI , J.(Oral)

CM-6409-CWP-2025

1. Through the instant application, filed under Section 151 of the CPC, for issuance of a directions upon respondent no.2 to allow the participation of the players (competitors) of petitioner(s)-Association for final entry in 25th Sub Junior National Wushu Championship (Boys and Girls) to be held at KSR College, Tirichangod, Tamil Nadu, from 26-31st May, 2025, and subsequently, in 34th Senior National Wushu Championship (Boys and Girls), at SMS Stadium, Jaipur, Rajasthan from 14-19th June, 2025, and also 24th Junior National Wushu Championship (Boys and Girls) at Gachibowli Stadium, Hyderabad from 01-06th July, 2025.

2. The petitioner(s)-Association has approached this Court seeking a writ of certiorari for quashing of order dated 04.02.2021 (Annexure P-3), passed by respondent no.2-Wushu Association of India (WAI), wherethrough, a Committee of three members was constituted to look after the affairs of the Wushu Association in the State of Haryana, and to conduct a selection trial, therefore, and to submit its report to respondent no.2-WAI, for further necessary action. This decision was primarily taken, on account, that on the date of decision, none of the faction of Haryana Amateur Association, was recognised by WAI.

3. Leaned counsel for the applicant submits that petitioner(s)- Associations were earlier affiliated with WAI, but they were wrongly de-

affiliated.

4. This Court has put a specific query to learned counsel for the petitioner(s)-Association, as to whether, the order of de-affiliation has been challenged before this Court, or any other forum, to which he has placed reliance upon impugned order (Annexure P-3), to submits that it is the only order, through which the petitioner(s)-Association were de- affiliated, therefore, the order is already challenged in the instant writ petitions.

5. This Court had examined the order (supra), and having not satisfied with the order (supra) pertaining to the de-affiliation of the petitioner(s)-Association, vide order dated 12.05.2025, learned counsel for respondents no.2 and 6, was directed to place on record de-affiliation order, wherethrough, the petitioner(s)-Association, has been de-affiliated by the WAI.

6. Today, learned counsel for respondents no.2 and 6, has placed on record a copy of an order dated 20.01.2021, which is taken on record as Annexure A-1, to submit that through this order the affiliation to the petitioner(s)-Association, was ordered to be withdrawn.

7. Now through the instant application, the petitioner(s)- Association, seeks a direction that the players suggested by them, be allowed to play at national level championship/tournament. The prayer, as made in the instant application, is in fact, a totally misconceived prayer, as none of its players, has earlier participated in the District Level or State Level games. The order (supra), of de-affiliation, has never been put to challenge by the petitioner(s)-Association, therefore, at this stage, the asked for prayer for allowing the players, as selected by the petitioner(s)-Association, to play at National level, that too without having played at any State level championships/tournaments, cannot be accepted.

8. Consequently, the instant application stands, dismissed CWP-242-2024 (O&M) &

CWP-7119-2024 (O&M)

9. At this stage, learned c
