1. The jurisdiction of this Court under Section 483 BNSS has been invoked for grant of regular bail to the petitioner in case FIR No.109 dated 17.09.2024 under Sections 4, 6 and 17 of POCSO Act, Sections 351(3), 308(2), 70(1) and 70(2) of BNS, registered at Police Station Women

Ballabhgadh, District Faridabad.

2. The translated version of the FIR is reproduced below:-

“Brief circumstances of the case are that on 17.09.2024, I am present at the police station and the victim girl came to the police station with her parents. The statement of the victim girl xxxxx recorded in the presence of the legal aid Shyamvati court sector 12 Faridabad daughter of Kuldeep resident village Dayalpur near water tank police station Sadar Ballabhgarh aged 14 years PH. 8287xxxxx stated that I am a resident of the above address and I study in 8th class in Tagore Public School. We are two siblings, I am the elder one and brother is younger. My father works in a private company and mother is a housewife. In February 2024, Anmol, who was in my class, gave me an Instagram ID named Ishwar, which ID Was ROYAL KARTIK Then I started talking to him and and we became good friends who is from my village. Then on 02.06.2024, Ishwar messaged me and called me at around 12.00 PM to Tanwar Oyo Hotel Ballabhgarh, which I reached at around 01.00 PM. Ishwar gave Shivani's ID and his ID in Oyo Hotel.

down. Ishwar made a video of me lying down in which both of us were there. I was wearing my clothes. Ishwar did not do anything wrong with me that day. After that I came to my home. Then the next day I got a message from Ishwar that I have your photo, give me five thousand rupees or else I will send your photo to your family. Then due to fear, I gave the five thousand rupees kept in the house to Ishwar. After that on 04.06.2024, I went to my maternal grandfather's house in Hodal. After that I stayed with my maternal grandfather for fifteen days.. I went to Jaipur to meet my maternal uncle, I stayed there for 10-12 days, there I got a message from Ishwar that I want more money, I will send your photo or video to your family, then I told Ishwar that I am at my maternal grandfather's house right now, I will give you more money when I come home, then I came to my house on 25/26.06.2024, after that I gave my mother's gold earrings to Ishwar, then Ishwar said sorry that I made a mistake, then both of us started talking to each other, then at the end of July Ishwar again asked for money from me, which I did not have, so I gave my mother's gold ring to Ishwar, then Ishwar called me again on 9.08.24 to Tanwar Hotel and forcefully did wrong things (rape) with me, after that I came to my house and my conversation with Ishwar stopped, after that I started talking to another boy Aryan who is from my village. Aryan told this to Ishwar that Shashi talks to me, then on 11/12.09.2024 at about 12.30 AM Aryan came to my house, at that time my family members were sleeping and Aryan forcefully did a wrong thing (rape) with me, after that at about 1.00 AM Aryan left my house, then Aryan came to meet me at night, then this thing also came to know to Ishwar, then Ishwar also got his photo clicked by Ishwar from his friend Lucky He sent a photo to my mother and said either
