1. Prayer in the present petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), is for grant of anticipatory bail to the petitioner, in case FIR No.49 dated 19.11.2025, under Sections 85 and 316(2) of BNS, 2023, registered at Police Station Women

Cell, District SAS Nagar, Mohali.

2. Vide order dated 11.03.2026 passed by this Court, the petitioner

was directed to join investigation. The said order is reproduced hereinafter:-

“1. Prayer in the present petition filed under Section 482 of BNSS, is for grant of anticipatory bail to the petitioner, in case FIR No.49 dated 19.11.2025 under Sections 85 and 316(2) of BNS, 2023, registered at Police Station Women Cell, District SAS Nagar,

Mohali.

2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the instant case on the statement of the complainant. It is submitted that the genesis of the

instant FIR lies in the matrimonial dispute between the parties. Marriage between the petitioner and the complainant was solemnised on 09.02.2025, however, within four months of their marriage, temperamental differences cropped up between the two, leading to the registration of the present FIR. It is submitted that the allegations levelled against the petitioner are sweeping and generic in nature, without any material on record to substantiate the same. The co-accused namely Gurjeet Kaur has already been granted concession of anticipatory bail by the Additional Sessions Judge, SAS Nagar vide order dated 12.12.2025 (Annexure P-2). It is submitted that the petitioner is ready and willing to join

investigation and cooperate.

3. Per contra, learned counsel for the complainant has vehemently opposed the submissions made by the learned counsel for the petitioner. She submits that in view of the serious allegations against the petitioner, he is not entitled to the

concession of anticipatory bail.

4. Status report by way of an affidavit of Ajitpal Singh, PPS, Deputy Superintendent of Police, Crime Against Women and Children, SAS Nagar filed by the learned State counsel is taken on record. A copy thereof has been furnished to the learned counsel for the petitioner and the complainant, who seek time to go through

the same and make submissions.

5. Accordingly, the case is adjourned to 25.03.2026.

6. In the meantime, the petitioner shall join investigation before the Investigating Agency/Officer. He shall abide by the following conditions as envisaged under Section 482(2) BNSS,

2023;-

(1) That the petitioner shall make himself available for interrogation by a police officer as and when required to do so.

(2) That the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts to the case so as to dissuade him from disclosing such facts to

Court or to any police officer.

(3) That the petitioner shall not leave India without prior permission of the Court.

7. Needless to mention that the investigating agency/officer shall continue with the investigation of the case in usual manner.

4. Learned State counsel, on instructions from ASI Kulwant Kaur, submits that in compliance of order dated 11.03.2026, the petitioner has joined the investigation on 19.03.2026 and is not required for any further

investigation.

5. Having considered the aforesaid facts and circumstances, the petition is allowed. Order dated 11.03.2026 passed by
