1. Petitioner Sukhdeep Kaur has filed instant petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.13 dated 17.01.2026 under Sections 108/56 Bharatiya Nyaya Sanhita, 2023 registered at Police Station Nathana,

District Bathinda, Punjab.

2. As per facts of the case, Harmanpreet Kaur, aged about 17 years, gave her statement that she was studying in 10^th class. Her younger brother was studying in 8^th class. On 19.12.2025, she had gone to attend a

party in the house of her friend Khushnoor Kaur. Her father dropped her to the house of her friend. Later-on mother of her friend brought her to Rampura Mandi from where she went along with her friend Sukhpreet Singh. She came to know that FIR was lodged against said Sukhpreet Singh and Khushnoor Kaur. She was brought to the police station and thereafter she stayed for the night in Police Station Rampura City and was left at Sakhi Centre, Bathinda on 21.12.2025. Her father brought her back home on 23.12.2025. Sukhpreet Singh wanted to marry her and started giving threatening calls to her father. He threatened to abduct her from her house. Sukhdeep Kaur was putting pressure in the Panchayat of village Batth to effect compromise. Consequently, she was under stress and was mentally disturbed. Her parents were also mentally tense. Due to the harassment, defamation and pressure for compromise from Sukhdeep Kaur, she consumed poison on 15.01.2026 to commit suicide. Initially she did not tell anything at home and when her health deteriorated she called her father and was admitted in Guru Ramdas Hospital, Bathinda. Thereafter, she was shifted to AIIMS Hospital, Bathinda for treatment. Statement of

prosecutrix was recorded. Finally, she passed away on 23.01.2026.

3. Learned counsel representing petitioner argued that allegations levelled against the petitioner are false. Earlier on the statement of Jagdeep Singh FIR No.258 dated 20.12.2025 was registered under Sections 137 (2)/96 of Bharatiya Nyaya Sanhita, 2023 wherein petitioner was granted interim bail vide order dated 23.01.2026 (Annexure P-3). petitioner is the mother of Khushnoor Kaur who was friend of the deceased victim. Allegations levelled against the petitioner are without any basis. Without considering the facts, her anticipatory bail application was wrongly declined by learned Additional District and Sessions Judge, Bathinda vide order dated 27.01.2026 (Annexure P-4). Petitioner is ready to abide by the terms of bail order. Therefore, her anticipatory bail petition

may be allowed.

4. Bail petition is opposed by learned counsel representing State. Facts narrated in the FIR are confirmed. It is pointed out that FIR is lodged on the statement of victim herself who died during treatment on 23.01.2026. Copy of her statement is Annexure R-1/T. Offence under Section 108 BNS was added as per GD No.8 dated 24.01.2026 (Annexure R-2/T). Investigation in this case is at initial stage. Considering the specific

allegations, petitioner is not entitled to the relief of anticipatory bail.

5. I have considered the aforesaid factual position. As per record, victim gave her statement explaining the alleged reason for consuming posion and named the present petitioner who was compelling her to effect compromise in the earlier FIR No.258 dated 20.12.2025 (Annexure P-2).
