1. The instant petition has been preferred by the petitioner under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short “BNSS”) for grant of regular bail in case arising out of FIR No.175 dated 19.08.2024 registered under Sections 420, 120B, 465, 467, 468 and 471 of IPC at Police

Station City Jagraon, District Ludhiana Rural.

The aforementioned FIR was registered on the basis of a written complaint submitted by the complainant Varinder Singh, alleging that he alongwith his brother owned 08 acres of land in Village Bir Akhara, Tehsil Jagraon, District Ludhiana. He had come to know from reliable sources that the petitioner by conniving with the co-accused Binder Singh, Sukhwinder Singh,

Kamaljit Singh, Parminder Singh and Amandeep Kaur as well as some unknown persons, had prepared a written agreement to sell dated 21.08.2023, for sale of the land owned by the complainant and his brother to Manpreet Singh Dhaliwal, on the basis of forged and fabricated documents and by impersonating the complainant. He had also come to know that all the above-named persons were engaged in the business of cheating innocent people, on the premise of getting them married to some NRI girl and on the basis of fake passports, visas as well as other fabricated documents. On receipt of the complaint, inquiry proceedings were conducted and report was submitted on 08.08.2024, as per which, the petitioner alongwith the co-accused was indulged in cheating and defrauding public persons by getting advertisements issued in the newspapers regarding proposal of marrying NRI girl and had been extracting lakhs of rupees from public persons on that premise and then fleeing with that money. The accused Parminder Singh was arrested on 21.10.2024. The petitioner and co-accused Amandeep Kaur were arrested on 27.11.2024. Meanwhile, some other victims had come forward and filed complaints alleging that by projecting accused Amandeep Kaur as an NRI, the petitioner and the co-accused were giving proposals of marrying accused Amandeep Kaur with the family members of the victim/victims and then had extracted money from them. The petitioner was identified by the victims. The co-accused were also arrested subsequently. It was revealed that accused Jagtar Singh had prepared a forged agreement to sell, aadhar card and had impersonated the complainant, at the time of signing the

forged agreement to sell. Investigation now stands concluded.

3. It is argued by learned counsel for the petitioner that she has been falsely implicated in this case on fake and general allegations. No evidence has been collected to show that she had any hand in preparation of agreement to sell in question. There is nothing to show that the petitioner was present at the time of execution of the alleged agreement. No sale deed had been executed on the basis of the agreement. She was not the beneficiary of any transaction, as no money has been transferred in her bank account in the transaction of the alleged agreement to sell. She is in custody since long. The trial will take considerable time to conclude. She has been acquitted in most of the cases which were registered against him and is on bail in other cases. The subject offences are triable by Magistrate. No useful purpose would be served by detaining him in custody anymore. It is, therefore, stressed that the petition deserves t
