1. Present petition has been filed by the petitioner praying for grant of regular bail in case FIR No.138 dated 22.12.2020, under Section 379-B, 34 of IPC, 1860 and Section 25 of the Arms Act, 1959 (offence under Section 379-B(2) vide Rapat No.16 dated 26.02.2021 and Section 201 of IPC vide Rapat No.36 dated 13.09.2023 added later on) registered at Police Station Chohla Sahib, District Tarn Taran.

2. Succinctly, facts of the present case are that the FIR in question was registered on the statement of complainant, namely, Jagdeep Singh. It was alleged that on 22.12.2020 at about 02:45 PM, when he was coming to Chohla Sahib from Dhun Dhai Wala after collecting the installments from members and was near the bridge of Dhun Dhai Wala, three clean shaven young men came there on a blue-black colour motorcycle make Hero Honda bearing No.PB-02-5281 with muffled faces. The boy sitting behind took out the pistol from his pant and pointed it at the complainant. He asked to give everything which complainant was carrying in his bag. Then he snatched the mobile phone and kit bag of the complainant and gave it over to his accomplice sitting in between the two. They all threatened the complainant his mobile phone, tablet and Rs.33,150/- lying in his kit bag and fled away. Request was made to take legal action against the culprits. The FIR was registered. On registration of FIR, investigation commenced. Petitioner was arrested on 11.02.2025. During investigation, complicity of the petitioner surfaced on the basis of disclosure statement of co-accused. On completion of investigation, challan was presented and on framing of charges, the trial commenced. Petitioner approached the learned Additional Sessions Judge, Tarn Taran, for grant of bail, however, after hearing both the sides, the said relief was declined to him vide order dated 28.04.2025. Hence, being aggrieved, petitioner is before this Court by way of filing the present petition for grant of concession of regular bail.

3. Learned counsel for the petitioner, at the outset, prays for the grant of bail on the basis of parity with that of co-accused, namely, Alambir Singh @ Alam. He has drawn the attention of this Court to the order passed by this Court in CRM-M-33964-2022 dated 27.10.2022 whereby co-accused of the petitioner, namely, Alambir Singh @ Alam has been granted the concession of regular bail. He has submitted that case of the petitioner is at par with the co-accused, who has been granted bail by this Court. He submits that on the basis of the parity, the petitioner deserves to be granted bail as case of the petitioner is similar to that of the co-accused, who has already been granted bail by this Court.

4. Per contra, learned State counsel has opposed the submissions made by counsel for the petitioner. However, he has endorsed the fact that case of the petitioner is at par with co-accused, namely, Alambir Singh @ Alam, who has already been granted bail by this Court. On instructions, he has submitted that challan has been filed, charges have been framed and out produced custody certificate of petitioner, today in the Court, which is taken on record.

5. After hearing learned counsel for the parties and perusing the record, it is deciphered that the petitioner is behind bars since the date of his arrest. As submitted by the State, out of 21 prosecution witnesses, 06 witnesses have been examined so far. The custody certificate produced would show that petitioner has suffered incarceration of 01 year, 01 month and 11 days as on 23.03.2026. It further reflects that the petitioner is not involved in any other case.
