1. Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:-

2. After hearing learned counsel for the petitioner on

20.05.2025 following was recorded:

1. In the present case, there are total six accused and one injured, who has suffered nine injuries, and out of which injury no.8 has been inflicted with sharp edged weapon. Besides, as per x-ray report, there are 4 fractures on the person of complainant. However, none of the accused has been arrested till date, whereas, FIR in question was lodged on 24.02.2025.

2. Similar situation is being noticed in several other cases also by this Court, and in one such case, i.e., CRM-M-19592- 2025 (listed today before this Court at Sr. No.105+223), there were total of 9 fractures on the injured person, and out of the total 11 accused, only three were arrested so far. This kind of conduct shows that the police officials in the State of Punjab are busy elsewhere, instead of examining the grievances/victimisation of the needy people/victims, who have been brutally beaten up by groups of accused persons.

3. Let the present petition be listed against on 09.07.2025 for further consideration.

4. This Court is more concerned with the issue that once the accused persons are not arrested by the police itself, despite having been named in specific, along with particular roles of causing injuries, no point is left in raising objections by the learned State counsel, during hearing of the anticipatory bail petition of the other accused.

Besides, a copy of this order be forwarded to the Director General of Police, Punjab, and the present order be treated as a notice for future proceedings. It is also observed that after examining the concern of Court, required steps are not taken, this Court would be compelled to call for the Director General of Police, Punjab, for clarification and issuance of necessary directions.”

2. Thereupon on 09.07.2025 following was recorded:

2. Counsel for the petitioner inter alia submits that petitioner has been attributed the role of causing injury on the left elbow of the injured With a stick, which is declared as simple in nature.

Further submits that co-accused namely Naseeb Singh has already been granted interim anticipatory bail by this Court, vide order dated 25.06.2025 passed in CRM-M-32899-2025, despite the allegation against him of having fired a shot in the air. Moreover, counsel for the petitioner submits that petitioner is ready to join investigation and to fully cooperate, if protected from arrest by this Court. Thus, prays for grant of anticipatory bail to the petitioner in the present case.

3. Notice of motion.

4. On advance notice, Mr. Neeraj Madaan, Sr. DAG, Punjab, puts an appearance on behalf of the respondent/State, and seeks some time to file status report in the matter.
