SANJAY VASHISTH, J. (ORAL)

1. Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioners, who has been booked in a criminal case arising out of FIR No.137 dated 18.06.2025, under Sections 115(2), 118, 305, 333, 298, 126(2), 351(3), 191(3), 190, 238 of BNS (offence under Seciton 118(2) of BNS added later on, vide DDR No. 32 dated 05.08.2025) at Police Station Lopke, District Amritsar Rural.

2. On 27.08.2025, following order was passed:

“(i) *** *** *** ***

(ii) Learned counsel for the petitioners, inter alia, contends that the alleged incident took place on 08.06.2025, however, FIR was registered belatedly on 18.06.2025 by the complainant, without offering any reasonable explanation for the delay.

(iii) It is further submitted that petitioner No.1 – Gurwant Singh has been attributed two blows with a dattar using its reverse side, which allegedly caused simple injuries on the back side of the shoulder and left thigh of the injured. As regards petitioner No.2 – Heera Singh, he is alleged to have inflicted an injury using a wooden log, resulting in an injury to the little finger of the left hand and left foot. All the injuries attributed to both petitioners have been declared simple in nature.

As per the injury chart detailed in paragraph No.9 of the present petition, it is the co-accused, namely Akashdeep Singh, son of Harjinder Singh, who is alleged to have given a dattar blow on the left side of the injured's head, which was declared grievous in nature. Additionally, FIR contains an allegation, wherein the complainant expressed suspicion that a licensed revolver of .32 bore belonging to Ranjit Singh was stolen by co-accused Akashdeep Singh, son of Kewal Singh, and petitioner No.2 – Heera Singh.

(iv) Counsel for the petitioners further refers to the orders dated 15.07.2025 passed in CRM-M-36961-2025 and 12.08.2025 passed in CRM-M-43805-2025, whereby co-accused Jasbir Singh, Charanjit Singh, Gurpal Singh and Harjinder Singh, have been granted the concession of interim anticipatory bail by this Court, and the said petitions are now fixed for 11.09.2025. Thus, prays for grant of concession of anticipatory bail to the petitioner in the present case.

(vi) On advance notice, Mr. Neeraj Madaan, Sr. DAG, Punjab, puts in appearance on behalf of the respondent – State, and Mr. Anmol Jeevan Singh Gill, Advocate, (for Mr. Gursharan Singh, Advocate), puts in appearance on behalf of the complainant, and files his vakalatnama in Court today, which is taken on record.

(vii) Adjourned to 11.09.2025.

(viii) Meanwhile, the petitioners are directed to join the investigation as and when required to do so by the Investigating Agency. In the event of their arrest, the petitioners shall be released on ad-interim bail, subject to their furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioners shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.).

(ix) Besides, it is directed that petitioners would hand over their passport to the Investigating Agency or to Court concerned, if they possess. Otherwise, would submit an affidavit, disclosing the fact that they do not possess any passport.

It is also directed that before leaving country any time during trial, petitioners would seek prior permission of the Court.”

3. Learned counsel for the petitioners submits that in pursuance to the directions issued by this Court vide order dated 27.08.2025, the petitioners have joined
