1. Prayer in the present Civil Revision Petition filed under Article 227 of the Constitution of India is for setting aside the impugned order dated 22.08.2025 (Annexure P-5), passed by the learned Additional Civil Judge (Senior Division)-cum-Rent Controller, Jind, whereby the application dated 22.04.2025 (Annexure P-3), filed by the petitioners-

plaintiffs for leading additional evidence, has been dismissed.

Brief facts of the case are that the petitioners-plaintiffs filed a suit for permanent injunction restraining the defendants from in any manner interfering with the peaceful, lawful, proprietary, physical and exclusive possession of the plaintiffs over the suit property. Notice of the suit was issued to the respondents, who appeared and contested the suit. Issues were framed and the parties led their respective evidence. It was at the rebuttal stage that the present petitioners-plaintiffs moved an application dated 22.04.2025 (Annexure P-3) for leading additional evidence. In the said application, the petitioners-plaintiffs sought to place on record the following documents:-

A) “Copy of passbook of Hitender son of Joginder Singh, Account No. 20097438328, maintained with the State Bank of India, Jind Branch, from which part sale consideration amounting to `5,50,000/- was transferred to the account of defendant Sushila.

B) Copy of passbook of Account No. 20097438339, maintained with the State Bank of India, Rohtak Road, Jind, in the name of Jitender son of Joginder Singh, husband of the plaintiff, from which part sale consideration amounting to `4,00,000/- was transferred to the account of defendant Sushila on 29.03.2017.

C) Certified copy of Mutation No. 1905 dated 16.05.2017, sanctioned on the basis of Sale Deed No. 7867 dated 29.03.2017 in favour of the plaintiffs, along with copies of ‘Jamabandi’ for the years 2016-17 and 2021-22.

D) Copy of Sale Deed No. 7867 dated 29.03.2017, registered in the office of Sub-Registrar, Jind.”

3. Notice of the said application was issued to the respondents to contest the same.

The learned Civil Judge (Senior Division)-cum-Rent Controller, Jind, in the impugned order, held that the present suit was filed in the year 2017 and issues were framed on 03.08.2017, and thereafter, the petitioners-plaintiffs concluded their evidence vide order dated 01.02.2023. 5. It was further held that at this stage, in view of the discussion above, permitting the said documents to be proved by way of additional evidence does not appear to be appropriate, as the other side would not get an opportunity to effectively cross-examine, and accordingly, the application was dismissed.

6. Since the petitioners-plaintiffs had already led their affirmative evidence, and the documents sought to be produced were not per se admissible, as recorded by the learned trial Court, this Court finds no illegality or perversity in the impugned order dated 22.08.2025 (Annexure P-5), passed by the learned Civil Judge (Senior Division)-cum-Rent Controller, Jind.

7. Consequently, the present Civil Revision Petition stands dismissed.

8. Pending miscellaneous application(s), if any, shall also stand disposed of.
