1. Petitioner Jasdeep Singh Dhillon has filed petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.92 dated 15.07.2024 (Annexure P-1), under Section 108 of BNS, 2023, registered at Police Station Kot Ise Khan, District Moga.

2. As per facts of the case, present FIR has been registered on the statement of Sukhjinder Singh alias Sukha who is the brother of deceased victim. It is alleged that victim got married with present petitioner about 05 years ago. After marriage, Jasdeep Singh Dhillon and his family harassed victim Veerpal Kaur on account of demand of dowry. They tried their level best to settle the dispute with in-laws family but there was no change in their behaviour. The victim was thrown out of the matrimonial home. She was being pressurized to give divorce. Her minor daughter aged 04 years was taken away from her and she returned to the parental house. The victim could not withstand the shock of atrocities of her in-laws and taking away of her daughter. On 14.07.2024, she consumed some poisonous medicine and also wrote down a suicide note. Ultimately, she died during treatment.

3. Learned counsel for petitioner pointed out that petitioner was granted interim bail vide order dated 18.10.2024 and he has joined the investigation. Learned counsel for petitioner referred to the writing given by victim dated 18.08.2020 (Annexure P-2) and writing of Sarpanch Gram Panchayat dated 08.05.2022 (Annexure P-3). It is pointed out that their minor daughter was having health issues right from the beginning. Her treatment record is Annexure P-5. In the said suicide note, present petitioner is not named. He is to look after his minor daughter and ready to cooperate with the investigating agency. Therefore, interim bail already granted in his favour may be confirmed.

4. Status report is already filed by learned counsel representing State confirming the fact that petitioner has already joined the investigation. Suicide note along with admitted handwriting of deceased is sent to Handwriting Expert for analysis. Petitioner and other co-accused have already joined the investigation on 09.08.2024.

5. I have considered the aforesaid factual position. Petitioner has cooperated with the investigating agency. Merits of the case will be decided after recording of evidence by learned trial Court. No purpose would be served by sending the petitioner behind the bars. Record indicates that petitioner is having minor daughter who needs medical treatment from time to time.

6. Considering the aforesaid factual position, without going on merits of the case, interim bail already granted in favour of petitioner – Jasdeep Singh Dhillon vide order dated 18.10.2024 stands confirmed, subject to the conditions as enshrined under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.

7. Petition is accordingly allowed.

8. Pending miscellaneous application(s), if any, stand disposed of accordingly as well.
