Present petition under Article 227 of the Constitution of India is filed by the defendant for setting aside the impugned order dated 11.11.2024 (Annexure P6) passed by the learned Civil Judge (Senior Division), Kurukshetra, vide which the application filed by the respondent/plaintiff seeking permission to lead secondary evidence of two agreements to sell viz. Agreement to Sell dated 26.02.2016 and Agreement to Sell dated 22.08.2016, was allowed.

2. Brief facts of the case as set out in the plaint (Annexure P-1), are that on 01.11.2017 the respondent/plaintiff had filed a Civil Suit No.1227/2017for recovery of Rs.84,70,000/- from the petitioner/defendant with regard to the payments made by the plaintiff in pursuance to the aforesaid Agreement to Sell dated 26.2.2016executed between the parties in respect of suit land measuring 55 kanal 12 marla.The said land was bought by the plaintiff along with one Paramjit Kaur.
