1. The present petition has been filed under Section 483 of BNSS, 2023, for grant of regular bail to the petitioner in case FIR No.48 dated 23.07.2024 under Sections 108, 3(5) of the BNS, 2023, registered at Police Station Sadar Abohar, District Fazilka, Punjab.

Learned counsel appearing on behalf of the petitioner submitted that the petitioner has been in custody for five and a half months and investigation in the present case has already been completed and thereafter challan has also been presented but no prosecution witness has been examined till date. He submitted that the petitioner has been falsely implicated in the present case wherein the wife of the petitioner has committed suicide. He further submitted that so far as the present petitioner is concerned there are no allegations of instigation against him even though he is the husband. He also stated that at the time of the suicide, the deceased wife of the petitioner had gone to her parental home along with the petitioner where she jumped into the canal and committed suicide. Therefore, the petitioner may be considered for the grant of regular bail .

3. On the other hand, learned State counsel as well as learned counsel for the complainant submitted that so far as the custody of the petitioner is concerned, the same is correct. It is also correct that the deceased along with her husband who is the present petitioner had gone to her parental home where she jumped into the canal and died.

4. I have heard the learned counsels for the parties.

5. It is a case where the allegations which are so contained in the FIR which was lodged by the brother of the deceased are that he has three elder sisters, one of whom is now deceased. She was 26 years old and her marriage was solemnized four months ago with the petitioner. The aforesaid FIR is reproduced as under.

“Statement of Angad Singh son of Hardam Singh resident of village Raipura, Tehsil Abohar District Fazilka, aged about 24 years, mobile No.86991-44313. I would like to state that I am resident of above noted address and I am working as labourer. We are five siblings. I have three elder sisters namely Gagandeep Kaur, Gurjit Kaur and Nirmal Kaur and all are married and we both younger brothers are unmarried. The marriage of my sister Nirmal Kaur aged about 26 years was solemnized about 4 months ago with Dilpreet Singh son of Balwinder Singh resident of Baba Jivan Singh Nagar, Moga. Since the colours of my sister is dusky, therefore her father-in-law Balwinder Singh, Mother-in-law Karamjit Kaur, Sister- in-Law Amandeep Kaur (sister of uncle of my Brother-in-Law) and my Brother-in-Law Dilpreet Singh were taunting my sister on petty issues by saying that your are not beautiful and your have brought less dowry, you have insulted our family”. They used to harass, taunt and beat my sister”. About 1 1/2 months ago, they beaten my sister then she informed us about it through telephone then I my elder sister Gagandeep Kaur went to her in-laws house at Baba Jivan Singh Nagar Moga and make them understood that we belong to poor family, we cannot give more dowry, therefore don't harass our sister for more dowry. Thereafter we came back to our house at Raipura. Now on 21.07.2026 at evening time, my Brother-in-Law Dilreet Singh and my sister Nirmal Kaur came to meet us at village Raipura an during night hours, my sister has informed us in the separate room that my in-laws family did not mend her ways and they are torturing her without any reason, I am very upset due to the said acts of my in- laws family, I will commit suicide. We make her understood
