1. The present petition under Section 482 Cr.P.C. has been filed for setting aside of order dated 22.05.2024 (Annexure P-1) passed by the Court of Additional Sessions Judge, Gurugram in CRA-273/2024 titled as Sudhir Kumar Vs. Padam Singh whereby the sentence of the petitioner under Section 138 of Negotiable Instruments Act has been suspended subject to the condition to deposit 20% amount of the compensation awarded by the trial Court, within next 60 days.

2. The counsel for the petitioner submits that respondent filed criminal complaint under Section 138 of NI Act against the petitioner wherein on conclusion of trial, the petitioner was convicted and sentenced to SI for a period of six months and further to pay compensation under Section 138 NI Act vide judgment and order dated 25.04.2024 by the Court of Judicial Magistrate Ist Class, Gurugram.
