The Prayer in this petition under section 439 Cr.PC is for the grant of regular bail in case FIR No.41 dated 09.03.2023 under Sections 22, and 29 of NDPS Act, 1985 registered at Police Station Samana, District Patiala.
2. The brief facts of the case are that a Swift car was seen coming from the side of village Tarkhan Majra which was signalled to stop. One person get out from the car and ran away. The driver of the car disclosed his name as Jagraj Singh @ Joga (petitioner) and recovery of 300 grams of intoxicant powder came to be effected from near the gear of the aforesaid swift car.
3. The learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. The mandatory provisions of Sections 42 and 50 of the NDPS Act have not been complied with in their proper perspective. No independent witness was joi
