1. After hearing the petitioner’s counsel, on 07.03.2025, following order was passed:-

“ Present petition has been filed under Articles 226/227 of the Constitution of India, seeking issuance of directions to official respondents No.1 to 4 for providing adequate protection/security arrangement for the annual Holi function to be organized by the petitioner society at Dada Dwara Ram Ji Temple, Village Kharaj Ramji, Tehsil and District Jind.

On advance notice, Mr. Kanwar Sanjiv Kumar, AAG, Haryana, appears and seeks time to file status report.

List on 11.03.2025.”

2. Today, learned State counsel has filed the status report dated 10.03.2025 along with inquiry report and Kalandra u/s 129/169 of BNSS, 2023 (appended as Annexures R-1 & R-2, respectively), in Court today. Same is taken on record, subject to all just exceptions. Office to tag the same at appropriate place.

A copy thereof has been handed over to the counsel for the petitioner.

3. Learned State counsel informs that on receiving of a complaint from respondent No.5 – Karambir, on 07.03.2025, DDR No. 17, dated 08.03.2025, for taking preventive action u/s 126/169 of BNS, 2023, was registered against some persons.

4. Further, by reading out paragraph No.6 of the status report, learned State counsel assures that all required steps have already been taken and would also be executed by deploying the sufficient number of police force to maintain law and order during the Holi festival.

The stand taken by the respondent – State, as mentioned in paragraph No.6 of the status report, is reproduced here-under:-

“6. That in view of facts and circumstance explained above, it is submitted that the parties are having disputes over the donation received in donation boxes of the temple during Holi Festival from 08.03.2025 to 14.03.2025. Sufficient number of police force have deployed to maintaining law and order during fair. On enquiry no cognizable offence was found to be committed and to maintain law and order preventive action against the parties had already been initiated. Close eyes are being kept on the activities of the persons of both the parties and legal against the parties/persons, who ever attempts to breach the peace or disturb law and order or commits some illegal act, shall be taken as per law.”

6. Therefore, in view of the stand taken in the status report, this Court does not find any substantial reason to continue with the proceedings in the present petition.

Accordingly, present petition is disposed of.

However, respondent No. 2 is directed to ensure the followup of its own decision, which has been projected before this Court in the status report, so filed by the State.
