Petitioners have filed the instant petition under Article 226 of the Constitution of India seeking issuance of writ in the nature of Mandamus for directing respondents No.2 and 3 to protect the life and liberty of the petitioners, who have married against wishes of respondents No.4 and 5.

Learned counsel for the petitioners submits that petitioner No.1-Dimpal, aged 24 years and petitioner No.2-Deepak, aged 25 years, have got married on 28.05.2025 as per Hindu rites, against wishes of the family members of petitioner No. 1 (Dimpal), arrayed as respondent Nos. 4 and 5. It has been further submitted that private respondents are threatening and trying to interfere in the marital life of the petitioners. Hence, they are seeking protection in that regard and have approached this Court by way of filing the instant petition.
HIMANI GUPTA 3. At the outset, learned counsel for the petitioners submits that
the petitioners would be satisfied at this stage, if a direction is issued to respondent No.2 (Superintendent of Police, District Nuh) to consider/decide their representation dated 03.06.2025 (Annexure P-4).
4. Notice of motion to respondent Nos. 1 to 3-State only.
5. Mr. S.K. Panwar, Addl. A.G., Haryana, who is present in the Court, accepts notice on behalf of respondent Nos. 1 to 3-State.
6. Given the nature of the order being passed, there is no necessity to seek any response by the official respondents or even to serve the private respondents No.4 and 5.
7. Having heard learned counsel for the petitioners as well as learned State counsel, I am of the considered view that every citizen is entitled to protection / enforcement of fundamental rights as envisaged under Constitution of India. It is the bounden duty of the State to protect the life & liberty of every citizen as enshrined under Article 21 of the Constitution of India.
8. In view of the above, present petition is disposed of with a direction to respondent No.2 (Superintendent of Police, District Nuh)/competent authority to look into representation dated 03.06.2025 (Annexure P-4), submitted by the petitioners, qua threat perception, if any, and take necessary steps, if any required, in accordance with law, to ensure that life and liberty of the petitioners is not jeopardized at the hands of private respondents.
9. However, this direction shall not be construed to validate the marriage, said to have taken place between petitioner Nos. 1 and 2. This order shall also not be taken to protect the petitioners from legal action for violation of law, if any, committed by them and will have no effect on any civil or criminal action, which could be initiated in the matter in accordance with law.
10. All the pending application(s), if any, shall also stand closed.
