1. In the instant petition filed under Section 528 of the BNSS, 2023, the petitioner has made various prayers viz. quashing of FIRs mentioned in the table Annexure P-1, consolidation/clubbing of FIRs and quashing of production warrants etc.

During the course of hearing, learned Senior counsel appearing on behalf of the petitioner fairly submits that though the present petition has also been filed for quashing the FIRs with further prayer for consolidation/clubbing of the FIRs, however, he restricts his prayer only qua consolidation/clubbing of all the FIRs registered against the petitioners on similar allegations by different complainants. He prays for withdrawal of his prayer for quashing the FIRs, with liberty to approach this Court again with better particulars.

3. The aforesaid prayer of the petitioner is accepted and the present petition is ordered to be dismissed as withdrawn, with the liberty aforesaid, qua quashing of the FIRs. Now, the present petition survives only qua the prayer for clubbing of various FIRs registered against the petitioner on similar allegations by different complainants.

4. Learned Senior counsel appearing on behalf of the petitioner submits that the petitioner is an urban designer and development professional. He is a Promoter/Director in WTC Faridabad Infrastructure Pvt. Ltd., which is one of the group companies of WTC Noida Development Co. Pvt. Ltd. The petitioner’s company, in order to develop the plotted residential society/projects, entered into Collaboration Agreements with the collaborators whereby it was agreed between the petitioner’s company and the collaborators that the petitioner’s company, in pursuance of the collaboration agreements, will obtain requisite/necessary licenses for developing the residential plotted society. It is submitted that the petitioner is a reputed person whose company, with bona fide intention to operate in Faridabad, acquired 87 acres of land and submitted applications for obtaining licenses under the Deen Dayal Jan Awas Yojna and subsequently, the Director, Town & Country Planning, Haryana, granted two licenses to the petitioner. After obtaining the licenses and necessary registration from the Haryana Real Estate Regulatory Authority (HRERA), plots were allotted to the collaborators. Thereafter, the Government of Haryana officially suspended the operation and implementation of the Deen Dayal Jan Awas Yojana program within the geographical boundaries of Gurugram and Faridabad districts and the petitioner’s company informed its collaborators about the said development and also about the proposal for alternative options but due to the business rivalry, their personal vendetta and in order to seek vengeance, the rivals started instigating the collaborators of the petitioner’s company to register FIRs as well as complaint under Sections 138 of the Negotiable Instruments Act, 1881 against the petitioner and resultantly, the petitioner has been roped in various FIRs, which are as follows:-

1. FIR No.119 dated 07.05.2024, registered under Sections 420 &

406 IPC, at Police Station BPTP Faridabad.

2. FIR No.245 dated 11.07.2024, registered under Sections 120-B, 420 & 506 IPC, at Police Station Old Faridabad.

3. FIR No.340 dated 26.09.2024, registered under Sections 120-B & 420 IPC, at Police Station EOW, Central Faridabad.

4. FIR No.341 dated 26.09.2024, registered under Sections 120-B & 420 IPC, at Police Station EOW, Central Faridabad.

5. FIR No.366 dated 15.11.2024, registered under Sec
