Present petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the petitioner in case bearing FIR No.131 dated 12.12.2024, registered for the offences punishable under Section 18 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘NDPS Act’) (Sections 61 & 85 of the NDPS Act added later on), at Police Station Banur, District Patiala.

2. The gravamen of the allegations against the petitioner is that he is an accused of being involved in an FIR pertaining to NDPS Act involving 02 kg 600 grams of opium allegedly recovered from his possession.

3. Learned counsel for the petitioner has iterated that the petitioner is in custody since 12.12.2024. Learned counsel for the petitioner has further submitted that the mandatory provisions of the NDPS Act have not been complied with, and thus, th
