Both the aforesaid petitions raise common questions of law on similar facts; therefore, the same are being decided together by this judgment. For brevity, the facts are being noticed from CWP No.28831 of

2023.

The petition has been filed (cid:1)(cid:2)(cid:3)(cid:4)(cid:5)(cid:6)(cid:7)(cid:8)(cid:1)(cid:7)(cid:6)seeking a writ of (cid:9)(cid:4)(cid:5)(cid:3)(cid:1)(cid:10)(cid:5)(cid:7)(cid:5)(cid:1) setting aside appointment of the fourth respondent to the post of Assistant Professor Zoology vide letter dated 05.06.2023. The respondent/University issued advertisement 3/2022 for various teaching posts, including one General category post of Assistant Professor Zoology. The petitioner and the fourth respondent applied for the same; the latter was selected and appointed on merit having secured 65.53 marks, as against 64.20 by the former.

Learned counsel for the petitioner(s) contend that the selection(s) need to be set aside on account of marks wrongly awarded under the heads of Postgraduate Training, Graduate Aptitude Test in Engineering (GATE), Publications in the relevant field, and Quality of Publications, under clauses 1(b), 3(iii), 4(a) and (b), respectively, of the selection criteria for Assistant Professor and equivalent posts, as circulated by the University vide memo dated 11.04.2018, Annexure P?3. More specifically, the (cid:11)(cid:1)(cid:5)(cid:12)(cid:3) contention is that the fourth respondent in, CWP No.28831 of 2023, could not have been given two marks for Postgraduate Training on the basis of a certificate dated 18.02.2020, Annexure P?10, which is an online course and cannot be considered a training programme. (cid:13)(cid:4)(cid:9)(cid:10)(cid:2)(cid:14)(cid:8)(cid:15), he could not have been awarded two marks for having cleared GATE on 17.03.2018, as it was valid for three years and the period came to an end much prior to closing date for submission of applications, i.e., 06.08.2022.
