Instant petition has been filed under Section 483 read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying for grant of interim regular bail to the petitioner in case FIR No.375 dated 18.09.2023 registered under Section 21 of the NDPS Act (Section 29 of NDPS Act added later on), registered at Police Station City Ferozepur, District Ferozepur (Annexure P-1), for a period of 04 weeks on account of marriage of son of the petitioner namely Ajaypal Singh.

Learned counsel for the petitioner has submitted that the petitioner deserve concession of interim bail as the pre-wedding Shagun ceremony of the son of the petitioner is scheduled for 13.09.2025 and the marriage is scheduled for 14.09.2025. He has placed on record the copy of the marriage invitation card (Annexure P-4).

The factum of marriage of son of the petitioner has also been affirmed by the Panchayat of the petitioner’s village and has placed on record the copy of Panchayatnama dated 15.08.2025 (Annexure P-5).

Learned counsel for the petitioner submits that being father of the groom, the presence of the petitioner is important in the marriage as he has to perform the rites and rituals of the marriage. He further submits that the petitioner was earlier granted concession of interim bail on medical grounds for a period of 06 weeks and has placed on record the copy of the order dated

31.07.2024 (Annexure P-6).

Notice of motion.

Mr. Ravinder Singh, DAG Punjab, present in Court accepts notice on behalf of the respondent-State and has opposed the prayer for interim bail by submitting that the petitioner is a habitual offender and many cases are registered against him, however, he has not denied the fact that the ‘pre-wedding Shagun ceremony and marriage of son of the petitioner is scheduled for 13.09.2025 and 14.09.2025 respectively.

This Court has considered the arguments of learned counsel for the parties.

Marriage of son of the petitioner is stated to be scheduled for

14.09.2025. The presence of the petitioner to attend the marriage and perform the rites and rituals being father of the groom is essential. It is also apparent from the document (Annexure P-6) submitted by learned counsel for the petitioner that the petitioner was earlier granted concession of interim bail by this Court for a period of six weeks.

Keeping in view the peculiar facts of the present case, without commenting any further on the merits, the present petition is allowed and the petitioner is ordered to be released on interim regular bail w.e.f. 06.09.2025 till 15.09.2025 subject to their furnishing bail bonds/surety bonds to the satisfaction of the learned trial Court/Duty Magistrate/CJM concerned.

The petitioner will surrender before the Central Jail, Ferozepur on 16.09.2025 at 10.00 A.M.
