1. The present contempt petition has been filed for deliberate and intentional disobedience of order dated 07.11.2022 passed by this Court in CWP-14277-2019.
2. The relevant portion of order dated 07.11.2022 passed by this Court in CWP-14277-2019, is reproduced as under:-
“5. In the premise, the petition is disposed of with a direction to respondent No.2 to consider the petitioners’ claim and pass an administrative order as per the applicable provisions of the 2016 Rules ibid. Let the needful be done at the earliest but in any case not later than 2 months.”
3. Learned State counsel submits that in compliance of order dated 07.11.2022, compliance affidavit of Neelkamal, District Sports Officer, Panchkula, Sports Department, Haryana dated 29.10.2024 along with Annexure R/1, has been filed. He further submits that in compliance of order dated 07.11.2022, a speaking order dated 24.01.2023 has been passed.
4. The relevant portion of compliance affidavit of Neelkamal, District Sports Officer, Panchkula, Sports Department, Haryana, filed on
29.10.2024, is reproduced as under:-
“4. That in the above-stated order dated 07.11.2022, the Hon’ble High Court directed to respondents to consider the petitioners’ claim and pass an administrative order as per the applicable provision of the 2016 Rules not later than 02 months. In compliance with the above-stated order of the Hon’ble High Court, the Sports Department, Haryana has already passed an order dated 24.01.2023 (Ann.P-2)”
5. A perusal of the above shows that order dated 07.11.2022 passed by this Court in CWP-14277-2019, has already been complied with by passing speaking order dated 24.01.2023, i.e. before filing of the present contempt petition.
6. This clearly indicates that there has been no violation or disobedience of the order dated 07.11.2022 passed by this Court as speaking order has been passed before filing of the contempt petition. Despite having due knowledge of the legal position that the contempt petition is not maintainable since there is no disobedience of any order passed by this Court, still the present contempt petition is filed, which is gross abuse of the judicial process and contributes significantly to the burgeoning pendency of cases before this Court. Hence, the present contempt is not maintainable.
7. This Court was going to impose cost of Rs.10,000/-, since, the present petition is gross abuse of judicial process, but on continuous insistence by learned counsel for the petitioner, the same is dropped.
8. In view of the above, the present contempt petition is dismissed
9. Pending application(s), if any, also stand disposed of.
