1. Robin Khan @ Rabin, aged 35 years has filed the present petition under Section 483 of BNSS, 2023 for grant of regular bail in case FIR No.09 dated 20.11.2020, under Sections 67, 67A of IT Act and under Sections 385, 467, 468, 471, 120-B and 201 of IPC registered at Police Station Cyber Crime MDC Panchkula, Haryana.

At the first instance when the matter was being adjourned on the request of learned State counsel, serious objection is raised by petitioner’s counsel and asked to decide the bail petition today itself and that too only on the basis of pleadings in the petition raised by him and the documents appended thereto.

Thus, instead of adjourning the proceedings, petition is taken up for hearing at the insistence of petitioner’s counsel.

3. Impugned FIR was got registered at the instance of complainant Jarnail Singh and the description given in the FIR is reproduced hereunder:-

“Sir, today I have received a missed call from No. 9145920152 and at the same time whats app No. Video came from 7413937261. In which a girl was seen and started doing wrong things. I disconnected the phone at the same time. Shortly thereafter, I received a threat in writing from this number that either send money to Google pay/Paytm account number 7073740351 for Rs.1199, otherwise I will make a pornographic video viral in your name. He has also sent me pornographic video. Please take legal action against him. I have also made whatsapp video and chat video that he has sent. 4. It is noticed that the FIR in the instance case was registered way back in the year 2020 and as pointed out by the petitioner’s counsel, petitioner was arrested on 13.05.2025 and since then he is inside jail i.e. for a period of 03 months and 21 days, only.

5. Allegations against the petitioner have been noticed from the order dated 13.06.2025, passed by learned Additional Sessions Judge, Panchkula, vide which, prayer for bail was considered and then rejected by learned Additional Sessions Judge, Panchkula.

6. From the said order, it is clearly noticed that petitioner had prepared a fake Aadhar card in the name of Ajay and Abid Khan by using his photographs on those Aadhar cards. On the basis of fake Aadhar cards, petitioner succeeded in getting three SIM Cards i.e. SIM No.7413937261 of Vodafone company issued on 31.08.2020, SIM No.9145920152 of Airtel Company issued on 28.09.2020 and SIM No.7073740351 on 22.10.2020.

On 24.10.2020, a missed call was given on the number of complainant and thereupon a video call was made from mobile No.7413937261 containing pornographic video. It is thereafter that the complainant received a threat message in writing from the said number to either send Rs.1,199/- to Google pay/Paytm account No.7073740351, otherwise caller will make a pornographic video viral by using complainant’s name.

7. During investigation, prosecution has also collected the material of CAF qua the aforesaid mobile number where the photographs of the petitioner have been affixed and also identified by the co-accused.

8. This Court, after taking note of all the facts and circumstances as discussed by the courts below in the impugned order, finds that the petitioner is involved in a serious offence. He has been making calls to individuals
