1. The jurisdiction of this Court has been invoked under Section 483 of BNSS for grant of regular bail to the petitioner in case FIR No.449 dated 30.06.2024, under Sections 304B, 34, 498-A IPC [later on Sections 498-A, 406 and 304B IPC (in alternative Section 302 IPC) were added and Section 306 IPC was deleted], registered at Police Station Ballabgarh City, District Faridabad.
2. The contents of the aforesaid FIR are reproduced herein below:-
“To The Chowki Incharge Aggarsain Chowk, Ballabgarh. Subject: My sister has been murdered for dowry by in-laws. Sir, Requested that I Rohit Kumar son of late Bhoop Singh is resident of Village Rahimpur, Palwal. Marriage of my sister Neetu was performed on 25.11.2021 with Mandeep of Bikram Colony. After 1-2 days of marriage the in-laws family started harassing her in which her husband Mandeep, her mother, her father in law, her Jeth (brother in law) and Jethani (sister in law) and her 3 Nanad (sister in laws) and many times gave beatings to her. 4-5 times we went by taking elders of the village and tried to pacify the matter. We had deposited Rs.5 lacs in our sister's account and she was given beatings to withdraw that amount also. Those money was also given to them after withdrawal and despite that matter did not calm and raised the demand of dowry time and again. We fulfill their demand every time but despite that also their demand increased and today on 30.06.2024, her sister in law create scene for money of Vidai and her husband Mandeep, father in law Mahavir, mother in law and brother in Sandeep and sister in law Reshmi abused her and then all murdered her by strangulating her. She came to our house 4-5 days ago on birth of my son. I gave her one tola gold chain, Rs.51000/- cash and clothes but despite they were not satisfied. In the marriage also we spent Rs.30-35 lacs. Hence you are requested that entire family of her in-law be arrested at the earliest. I shall be highly obliged. Name Rohit Kumar brother of Neetu Ph No.96710xxxx, 999293xxx Sd/-Rohit 30.06.2024.”

Learned Senior counsel for the petitioner submits that the petitioner has been falsely implicated in the instant FIR, which was registered on the complaint made by the brother of the deceased against the petitioner and his family members, leveling generic, vague and non specific allegations. It is submitted that the true factual dimension is that deceased had committed suicide due to the atrocities inflicted upon her by the complainant, who had got the land owned by her registered in his name, and had also taken a sum of Rs.5 lacs from her on the pretext of marriage. In fact when the deceased had previously visited the house of the complainant for a function, her jewelry also purportedly got stolen, for which an FIR was also registered. Even on the fateful day, the deceased had made calls to the complainant. As such it is evident that the deceased committed suicide because of the actions of the complainant and not because of the petitioner. Furthermore, no complaint was ever made by the deceased in the entire duration of her marriage with the petitioner. It is contended that there is also no evidence to substantiate the version sought to be made out by the prosecution. In fact, in pursuance to the deposition of the complainant dated 07.05.2025, an application under Section 319 Cr.P.C. was moved on 07.05.2025 for summoning the father-in-law, mother-in-law, brother-in-law
