SUBHAS MEHLA, J Through this petition, petitioner seeks anticipatory bail in case FIR No.0440 dated 24.08.2020 under Sections 406, 420 IPC (Sections 409, 467, 468, 471, 120-B IPC added later on), registered at Police Station, Sector-5, Panchkula.

2. As pr the prosecution version, there are two college run by Smt. Sarti devi Charitable Trust Ateli Mahendergarh 1. Rohitash Institute of management Ateli Mahendergarh. 2. Rohitash Degree College Ateli, Mahendergarh. The Higher Education Department received fake claims of 53 MBA students of Rohitash Institute of Management, Ateli, Mahendergarh and due to this a FIR was got registered in the Police Post, Sec-5 Panchkula on dated 18-08-2018 (Copy enclosed) Whereas, the Department also wanted to clarify about the scholarship claims for the session 2017-18 of Rohitash Degree College, Ateli, Mahendergarh, which is induced at S. No. 2 above. In this, a letter was written to M.D.U University Rohtak on dated 13-05-2019 (wrongly mentioned as 2019). In its reply dated 09.07.2018, University has clarified that only 21 students are genuine out of 698, but the University also indicated that the Rohitash degree College now stands affiliated with Indira Gandhi University Meerpur, Rewari from the session 2017-18, and is under direct control of that University. In view of that the information in respect of students admitted during the session 2017-18 (Part-1) could be obtained from the Registrar Indira Gandhi University Meerpur (Rewari). Accordingly a letter was written to Indira Gandhi University Meerpur, Rewari on dated 05- 08-2019. The Indira Gandhi University Meerpur, Rewari in his reply on dated 19-08-2019 clarified that only 35 students are genuine. In view of above situation a show cause notice was issued to Rohitash Degree College on dated 02-03-2020 to explain their position. In reply of Rohitash Degree College, Ateli, Mahendergarh on dated 24.03.2020 requested to extend the date of reply up to 15 days but the reply of the college is still awaited. The matter was submitted to the Principal Secretary to Govt. Haryana Higher Education Department. In the matter it was directed to lodge a FIR against the Rohitash Degree College, Ateli, Mahendergarh.

3. Learned counsel for the petitioner has contended that the Court below has accepted an untraced police report in this matter as record is not available. The present FIR is a sheer abuse and misuse of process of law. The degree college as well as the Institute did not have any role in admission. The uploading of documents on the portal by the students was to be verified by officials of Director Higher Education and the seat was allotted to students on merit basis, as per their choice, after registration of student was made. The Institute has no role in the above procedure of admission. The petitioner has no criminal antecedents, and she has no relation with the commission of offences as alleged by the prosecution and has been falsely implicated. The petitioner and her husband were called by the police to join the investigation number of times, but nothing was recovered from them. It is a case of no evidence against the petitioner. In similar type of FIRs, she got bail from the coordinate Bench vide order dated 27.09.2024 passed in CRM-M-30947 of 2024. Moreover, the offences are triable by the Magistrate. Thus, no fruitful purpose will be served by sending the petitioner behind bars. The petitioner is ready and willing to join the investigation as and when required and further undertake to abide by any condition as may be imposed as envisaged under Section 482 of BNSS.
