1. By virtue of the present petition under Section 483 BNSS, petitioner, an accused in case bearing FIR No. 578 dated 30.11.2024 registered against him, for commission of offences punishable under Sections 3, 5, 13 of Haryana Gausanrakshan and Gausamvardhan Act, 2015 (later on addition of Section 17 of Haryana Gausanrakshan and Gausamvardhan Act, 2015 and Section 238 of BNS) at Police Station Sadar Dabwali, District Sirsa, has prayed for grant of bail.
2. Relevant facts as emerging from documents on record be noticed hereinbelow:-
Gurpinder Singh, son of Baldev Singh, resident of Giddarkhera, set the criminal law in motion. Contents of FIR if translated in English read as under:-
To, the Incharge, Police Post Chautala. Sir, it is respectfully submitted that I Gurpinder Singh son of Baldev Singh, am permanent resident of Gidderkhera. We live in Dhanies within the revenue area of Giddarkhera. Today, in the morning I and my father Baldev Singh had gone to field to see wheat. Then we saw that in our field near the butt (boundary), the pieces of meat of Neel Gai, Cow/Ox have been scattered. We saw that there is digging near butt (boundary). It seems that Cow/Ox has been buried in land after cutting. Then I informed regarding this at dial 112. Then dial 112 and you have reached at the spot. Some unknown persons after slaughtering Cow/Ox have buried in the land in field after cutting. Strictest legal action be taken against unknown persons.
After the registration of the FIR, IO visited the place of occurrence, Doctors from Animal Husbandry Department were called at the spot, photographs of carcasses lying at the spot were taken. These were got examined from the Board of Doctors, statements of witnesses were recorded. 3. On 02.12.2024, on the basis of secret information, accused Arif Ali son of Abdul Gaffar and co-accused Imdad Khan son of Saswar Khan, resident of Village Nava, Tehsil and District Hanumangarh, were arrested, who during interrogation, confessed to their involvement in the commission of crime and also disclosed names of the other persons, who were involved in the commission of offence, including the name of present petitioner and co-accused Salam, son of Murad Ali, Fariyad son of Suba Sadak and Mammu son of Yasin. It is further the case of prosecution that at the instance of co-accused Imdad Khan, one knife, unnumbered TVS Sports Motorcycle, used in the commission of offence were recovered, which were taken into possession.
On the basis of disclosure statements of co-accused Arif Ali and Imdad Khan, petitioner-Salman Khan was arrested on 28.12.2024.
In pursuance of disclosure statement made by the petitioner-
Salman, one TVS Sports Motorcycle No.RJ-31SV-2923, used in the commission of offence was recovered, he (P) also identified the place where he had thrown the pieces of gunny bags.
After completion of investigation, challan complete in all respect was filed against the present petitioner, Arif Ali, co-accused Imdad Khan, Salam and Mohd. Salam on 30.01.2025. Admittedly, some of the accused involved in the incident have not yet been arrested.
4. Allegation against petitioner is that he along with the other co- accused slaughtered a cattle, after which they all extracted beef with the help of knife and Axe, took away the beef and threw the carcasses in the field.
5. The bail application of the present petitioner was dismissed by the learned Additional Sessions Judge Sirsa in terms of order dated
25.02.2025. Aggrieved of the same, present petition has been filed.
6. Perusal of the paper book reveals that petitioner Salman Khan had been granted the concession of interim bail vide order dated 21.04.2025. There
