1. The petitioner incarcerated in the FIR captioned above came before this Court under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, [BNSS], seeking regular bail.

2. Per paragraph 09 of the bail application and para 8(d) of the reply, the petitioner has the following criminal antecedents:

3. The facts and allegations are being taken from the reply filed by the State, which reads as follows:

“4. That the factual matrix giving rise to the registration of the present case/FIR is that on 19.01.2024, A.S.I Sukhwinder Singh, CIA Staff, Moga received information from secret informant that Kulwinder Singh @ Kinda and Parminder Singh @ Pinda i.e the present petitioner, who both are members of a gang headed by dreaded gangster Navdeep Singh @ John Buttar and both of them have been supplied with huge quantity of arms and ammunitions by Navdeep Singh @ John Buttar to carry out incident/offence(s). Both of them are present at back side of District Courts, Moga, in the parking in front of Department of Education, Moga in white coloured I-

20 car bearing registration number DL-2C-AR-4201 and they are waiting for someone and if raid be conducted, they be apprehended red-handedly with illegal arms and can ammunitions.

That A.S.I Sukhwinder Singh, CIA Staff, Moga along with fellow officers reached the place told by the secret informant and conducted the raid and accused Parminder Singh @ Pinda son of Darshan Singh i.e the present petitioner and Kulwinder Singh @ Kinda son of Baldev Singh, the co-accused were apprehended while trying to make an escape in their 1-20 car bearing Registration No. DL-2C- AR-4201 and upon personal search of accused Parminder Singh @ Pinda, i.e the present petitioner, from his left fold, a point 32 bore automatic pistol and from his right fold a point 32 bore black coloured pistol were recovered and upon unloading, from the first pistol of point 32 bore, two live cartridges and from other pistol of point 32 bore, one live cartridge was recovered and then from the personal search of accused Kulwinder Singh @ Kinda son of Baldev Singh from his left fold, a country made point 32 bore pistol and from his right fold another country made point 32 bore pistol were recovered and upon unloading the first pistol of point 32 bore, two live cartridges and upon unloading the second pistol of point 32 bore, one live cartridge were recovered and that from the dash board of the car, one country made pistol of point 30 bore and one revolver of point 32 bore were recovered and upon unloading from point 32 bore revolver, two live cartridges were recovered. Since, the petitioner and the co-accused were found in conscious possession of 6 illegal fire- arms, of which they have not been able to produce a valid license, they were found to have committed an offence under Section 25(6), 25(7) and 25(8) of Arms Act, 1959. Consequently, a ruqa was sent and case/FIR No. 15 was registered against the present petitioner and the other co-accused.”

4. Counsel for the petitioner seeks bail on the grounds of prolonged custody.

5. The petitioner's counsel prays for bail by imposing any stringent conditions and contends that further pre-trial incarceration would cause an irreversible injustice to the petitioner and their family.
