1. By virtue of the present petition under Section 483 BNSS, petitioner, an accused in case bearing FIR No. 139 dated 09.05.2024 registered against him, for commission of offences punishable under Sections 302, 34, 120-B, 216 IPC and Section 25 (1-B)(a), 27, 29 of Arms Act and Section 42, 45 of Prison Act at Police Station City Jhajjar, District Jhajjar, has prayed for grant of bail.
2. Relevant facts as emerging from documents on record be noticed hereinbelow:-
Satpal resident of Ward No.4 Ghosiyan Mohalla Jhajjar, set the criminal law in motion by filing a complaint pointing therein that he had two sons namely Deepak and Anuj. Deepak is married, whereas Anuj was unmarried. At about 7.30-8PM on 09.05.2024 he had gone towards Ramleela Ground for evening walk. On his way back, when he had reached a little ahead of Punjab Rasoi, he saw 3-4 boys running towards Bahadurgarh, who had weapons in their hands. After covering some distance he heard noise emanating from the office of his son Anuj. When he reached at the office he was shocked to see his son Anuj lying in pool of blood, who had suffered bullet injuries. With the help of Parveen, Aakash and Arun, he rushed his son to Civil Hospital Jhajjar where the young boy (Anuj) was declared brought dead.
Primarily with this backdrop, complainant who had lost his son requested the police authorities to catch hold of all those who were involved and to initiate appropriate criminal proceedings against them. On the basis of the said complaint, a formal case vide FIR No.139 dated 09.05.2024, under Sections 302 read with Section 34 IPC and Sections 25, 54 and 59 of the Arms Act, was registered against the petitioner.
During investigation, IO visited the place of occurrence, blank cartridges and blood stained soil were taken into possession, postmortem examination of the dead body was got conducted after which it was handed over to the relatives for performing last rites. Doctor, who conducted Postmortem Report examination, opined that Anuj died on account of multiple firearm injuries having caused to his vital organs.
On 10.05.2024, complainant Satpal got his supplementary statement recorded mentioning therein that Akshay son of Hari Om, Naresh @ Sethi son of Dhani Ram, both residents of Jhajjar and Rohit @ Guddu son of Suresh, Dev Dutt @ Deva son of Ram Chander, alongwith their associates had murdered his son Anuj.
On 12.05.2024 co-accused Rohit @ Guddu son of Suresh was arrested, who suffered a disclosure statement on the basis of which Section 120-B IPC was added. In the said statement co-accused Rohit mentioned that Akshay, son of Hari Om had told him that Naresh @ Sethi, who is his uncle had told him to murder Anuj. Importantly enough, co-accused Rohit disclosed the involvement of the present petitioner. During the further course of investigation, CCTV footage of the camera installed near the spot of the incident was taken into possession wherein the present petitioner could also be seen.
On 17.05.2024, petitioner Dharamveer @ Moni @ Aakash son of Dharam Singh and co-accused Ravinder @ Bachha son of Jai Bhagwan were arrested. At the instance of co-accused Ravinder recovery of motorcycle HR14Q 1574 used in the offence, one magazine, 5 live cartridges and clothes worn at the time of incident alongwith mobile phone were effected. On 18.05.2024 another accused Suman wife of Joginder was also arrested, in pursuance of whose disclosure statement, recovery of scooty bearing No.HR14A 3428 alongwith mobile phone (make Oppo) were effected which were taken into possession.
