1. The present petition has been filed by the petitioner under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail in case bearing FIR No.75 dated 30.01.2024 registered under Section 304-B of Indian Penal Code, 1860 (498-A of IPC was added later on) at Police Station Indri, District Karnal.

2. Status report by way of an affidavit of Sh. Satish Kumar, HPS, Deputy Superintendent of Police, Indri, Karnal, on behalf of the respondent-State, filed in the Registry is taken on record. Learned State counsel, on instructions from SI Rohit, submits that the complainant has been informed about the pendency of the present petition. However, no one has put in appearance on behalf of the complainant.

Brief facts relevant for disposal of present petition are that on 30.01.2024 ASI Sulinder Singh received an information that one Kajal wife of Sanjiv (the present petitioner), resident of Village Biana, District Karnal has committed suicide by hanging herself. On this information, ASI Sulinder Singh along with other police officials reached at the spot, where Rajinder (father of the deceased) presented an application alleging therein that he has three daughters and one son. On 26.01.2023, marriage of his elder daughter namely Kajal was solemnized with the petitioner, who is drug addict. Out of the said wedlock, one girl child was born. The petitioner and his relatives used to give beatings to his daughter Kajal on account of demand of dowry. In the evening of 30.01.2024, his cousin namely Babli wife of Parmod Kumar, resident of village Garhpur Khalsa telephonically informed him that his daughter Kajal has committed suicide by hanging herself due to consistent demand of dowry made by her in-laws. On this information, FIR under section 304-B of IPC was registered. On 30.01.2024, post mortem examination of dead body of Kajal was got conducted. On 08.02.2024, a two page suicide note written by deceased-Kajal was taken into police possession. Accused Sanjiv Kumar was arrested on 10.02.2024. Other persons named in the FIR namely Rajbir, Anil, Saroj and Amandeep were found innocent. Offence under section 498-A of IPC was added in the FIR. Final report/challan has been presented in the court. Hence, the present bail application.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. He submits that the allegations levelled in the FIR are not supported with any cogent evidence and therefore, ingredients of Section 304-B are not fulfilled. He submits that father (i.e.

complainant), uncle, cousin and aunt of the deceased, who have been examined before the Trial Court as PW-1 to PW-4, respectively, have not supported the case of the prosecution before the Trial Court. The father of the deceased in his testimony recorded before the Trial Court stated that his son-in-law namely Sanjeev Kumar never harassed her daughter and he also never used to gave beatings on account of demand of dowry. His daughter used to remain in tension due to her illness due to which she committed suicide by way of hanging herself. PW-2 to PW-4 have also recorded their statements before the Trial Court to the same effect.

5. Learned counsel for the petitioner further submits that the petitioner is behind the bars since 10.02.2024 and he is not involved in any other case. He also submits that investigation in the present case is completed; challan stands presented; charges have been farmed and out of total 19 prosecution witnesses, only 11 have been examined so far.
