Present fifth petition has been filed under Section 439 of the Code of Criminal Procedure, 1973 (for short ‘Cr. P.C.’) for grant of regular bail to the petitioner in case bearing FIR No.132 dated 11.05.2023, registered for the offences punishable under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘NDPS Act’), at Police Station STF Phase-4, District SAS Nagar, Mohali, Punjab.

2. The gravamen of the FIR in question is that the petitioner is an accused of being involved in an FIR pertaining to NDPS Act involving alleged recovery of 11,400 intoxicant tablets (Alprazolam) from a plastic bag clinged on the patrol tank of motor-cycle, without number.

3. Learned counsel for the petitioner has iterated that the petitioner is in custody since 11.05.2023. Learned counsel has further submitted that mandatory provisions of the NDPS
