1. Petitioner Amit Goyal has filed instant petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.70 dated 31.07.2024 (Annexure P-1) under Sections 406, 498-A of IPC registered at Women Police Station, District Jalandhar.

As per facts of the case, complainant Manpreet Kaur @ Manpreet Goyal filed written complaint against her husband Amit Goyal and other members of in-laws’ family for maltreatment on account of demand of dowry. It is submitted that her marriage was solemnized on 28.10.2017. Her parents had given gold ornaments, shagun and customary gifts as detailed in the FIR by spending huge money. She was also given clothes and other gifts. He further gave cheque of Rs.1 lakh to purchase household articles. Said amount was transferred in the account of her husband. Marriage was performed as per desire of her husband and his family with great pomp and show by spending Rs.6.91 lakhs. At the time of marriage, she being an Engineer was serving with Mursar Consulting Private Limited Company, Noida whereas her husband was also an Engineer working with TCS Company in Noida. She was drawing salary of Rs.1.20 lakh per month which was credited in her account with HDFC Bank. Her credit card with Yes Bank was used by her husband forcibly. She was continuously harassed by her husband. Her husband had withdrawn huge amount from her account with HDFC Bank and Yes bank total amounting to Rs.27,28,141/-. Out of this amount, Rs.6.50 lakhs were transferred in the account of her mother-in- law Nirmala Goyal. In this way her husband forcibly misappropriated huge amount from her bank accounts. She was doing job and was also doing household work. She was not permitted to use her salary. She gave birth to a daughter on 08.10.2020. They were unhappy with the birth of a girl child. They started raising demand for money which she could not satisfy. She was not permitted to go to her parental house at Jalandhar. Her husband used to quarrel with her and also inflicted fist blows on her head. She remained under fear and stress. She has narrated various incidents which took place in the matrimonial home. Matter was also compromised but it could not last for a long time. Finally, matter was reported to the police and after inquiry, present FIR has been registered.

3. Learned counsel for the petitioner argued that the allegations levelled against him are false. She had filed complaint against the entire family who were found to be innocent. She had levelled allegations naming one of the relative who had already expired. It is pointed out that before marriage complainant cheated the petitioner, as a result their engagement was broken but finally their marriage was performed. Petitioner has not utilized the money of his wife. In-fact, she has taken money from the petitioner from time to time which are detailed in Annexures P-6 & P-7. He has also placed on record details of salary account of the complainant Annexures P-9 to P-14 showing details of money utilized by the complainant as well as the money transferred by her in the account of her mother and in her other bank account. In this situation, allegations levelled by the complainant that he utilized money of his wife does not hold any ground. For the investigation of present case, his custodial interrogation is not required. He is ready to abide by the terms and conditions of bail order.

Therefore, his anticipatory bail petition may be allowed.
