The prayer in the present petition under Article 226 of the Constitution of India is for the issuance of a writ in the nature of Habeas Corpus direcitng respondent Nos.2 and 3 to produce the detenue namely, Samaira Seth (minor daughter of the petitioner) who has been illegally and forcefully detained by respondent Nos.4 to 8.

2. The petitioner is the wife of respondent No.4-Vishal Seth. The instant Habeas Corpus petition has been filed seeking custody of detenue Samaira Seth, the minor daughter of the petitioner and respondent No.4.

3. During the pendency of the instant petition, a compromise has been arrived at between the parties. The terms of the compromise are as under:-

COMPROMISE Compromise between Manpreet Kaur wife of Vishal Seth daughter OF Harjinder Singh, resident of House No. 18150, Gali No. 2, Prem Nagar, Tung Bala, Majitha Road, Amritsar.

....First Party And Vishal Seth son of Vinay Seth, resident of 181, Gali No. 13, Batala Road, New Pawan Nagar, VTC Amritsar.

...Second Party

1. That both parties (1^st and 2^nd) are husband and wife, having married on 20.04.2018 and two daughters are born out of this wedlock. Elder is Agamjot and younger is Samaira Seth.

2. That the first party has filed CRWP/9453/2025 titled as Manpreet Kaur V/s State of Punjab and others seeking custody of minor daughter Samaira Seth born on 11.11.2024 from the wedlock of party 1 & 2. The minor daughter is being handed over today i.e. 27.10.2025 by to party at 2^nd to party at 1^st place in court today. The parties have agreed to the following terms:-

(1) That 1^st party will bring both daughter (Agam jot and Samaira Seth) at District Court, Amritsar on every Saturday at 3 PM for having meeting with party at 2^nd place.

(ii) That 2^nd party will also bring both daughters (Agamjot and Samaira Seth) on 11.11.2025 at District Court, Amritsar have meeting with party at 2^nd place.

(iii) That both the parties have expressed their consent on the above settlement about visitation rights of party at 2^nd to minor daughter.

4. In furtherance of the compromise, the custody of the child has been handed over by respondent No.4-Vishal Seth to his wife Manpreet Kaur (petitioner).

5. In view of the above, the present petition is disposed of with the directions to both the parties to honour the settlement dated 27.10.2025.
