1. This petition is by the student, who claims to have been admitted in B. Pharmacy Course in M/s Doon Valley Institute of Pharmacy and Medicine, Outside Jundla Gate, Karnal, Haryana (for short ‘the College’).

2. The prayer in the writ petition is to command the Pandit Bhagwat Dayal Sharma University of Health Sciences, Rohtak (for short ‘the University’) to accept examination form of the petitioner and issue admit card to appear in B. Pharmacy 1^st semester examination scheduled to be held for 10.06.2025.

Admitted facts of the case are that the college concerned has been granted permission by the Pharmacy Council of India to run the couse and admit students for the academic session 2024-2025 on 13.12.2024. The affiliating university of the college, however, has declined affiliation to run such course by the college concerned.

4. Notwithstanding rejection of affiliation by the university, the college has admitted various students including the present petitioner. According to the petitioner, once he has been admitted by the college concerned, the action of the university in not accepting his examination form is arbitrary.

Learned counsel for respondent No.1-university raises an objection to the maintainability of the writ petition on the ground that the college had approached the Hon’ble Supreme Court of India by filing writ petition No.167 of 2025, challenging the decision of the university dated 31.12.2024, refusing to grant affiliation to run B. Pharmacy course for the academic session 2024-2025. A prayer was also made in the writ petition filed before the Hon’ble Supreme Court to register 25 admitted students in view of the permission granted by the Pharmacy Council of India in favour of the college to run such course. This writ petition of the college, however, has been dismissed by the Hon’ble Supreme Court vide order dated 09.05.2025. Learned counsel for respondent No.1-university, therefore, submits that once the relief prayed for by the college to admit students, has been declined by the Hon’ble Supreme Court, it would not be open for this Court to accept such prayer at the instance of the petitioner/student.

6. Though various submissions are advanced, but it remains undisputed that for the academic sessions 2024-2025, the university has declined affiliation to the college for running B. Pharmacy Course. The decision of the university was put to challenge before the Hon’ble Supreme Court, but the same was upheld by the Hon’ble Supreme Court vide order dated 09.05.2025.

7. Once that be so, it would not be open for this Court to grant any relief in favour of the petitioner, which has already been declined by the Hon’ble Supreme Court in the writ petition filed by the college itself.

10. In that view of the matter, the writ petition lacks merit and is accordingly dismissed.

11. All pending misc. application(s), if any, also stand disposed of.
