Main Case

2^nd petition has been filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying for grant of interim bail to the petitioner in case FIR No.27 dated 28.02.2025 registered under Sections 22, 61 of the NDPS Act at Police Station Sadar Rupnagar, District Rupnagar (Annexure P-1), for a period of two months on the ground of his serious health ailment i.e. last stage of liver failure.

Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case and while confined in judicial custody the petitioner has suffered serious ailments as he is suffering from last stage of liver disease and as a consequence the petitioner requires constant care and treatment and therefore, deserve concession of interim bail. To support his contention learned counsel for the petitioner has placed on record the medical report reflecting his health ailments as Annexure P-2. He further submits that the condition of the petitioner is deteriorating day-by-day as the petitioner cannot consume any solid food and requires customized and specialized liquid diet. He further submits that apart from liver disease the petitioner is also suffering from kidney infection and other related diseases. Thus, he prays that present petition be allowed.

Learned State counsel has filed medical status report of the petitioner, which is taken on record. He has opposed the prayer for interim bail. However, he has not denied the fact that the petitioner is suffering from serious health issues.

This Court has considered the arguments of learned counsel for the parties.

As per the medical status report of the petitioner submitted by learned State counsel, the petitioner is suffering from acute abdominal bloating, difficulty in breathing, loss of appetite and frequent vomiting on ingestion of solid food and liquids. He underwent ultrasound of whole abdomen and blood tests, the findings of which are reproduced below:

“1. Hepato-spelenomegaly (increase size of liver & spleen) with liver parenchymal changes & liver Space occupying lesion (Largest measuring 4.6x3.0 cm in right lobe of liver):

Suggestive of hepato cellular cancer (HCCa).

2. Heterogenous content in portal vein, suggestive of portal vein thrombosis (PVT)

3. Thickened GB wall.

4. Moderate ASCITES.

5. Right kidney stones.

The inmate underwent LFT and RFT tests, report of which showed very high blood levels of:-

● Urea (107.0 mg/dl)

● Creatinine (2.47 mg/dl)

● Bilirubin direct (0.90 mg/dl)

● SGOT (61.7 U/L)

● Alkaline Phosphates (320 U/L)

From the findings of the ultrasound and blood test reports, it prima facie appears that the petitioner is suffering from multiple health ailments. He had been frequently referred to PGIMER Chandigarh on different occasions for treatment. The petitioner is stated to undergo further treatment at PGIMER, Chandigarh on 30.10.2025 and is also on medications as prescribed by the concerned department at PGIMER, Chandigarh.

Keeping in view the peculiar facts of the present case, without commenting any further on the merits, the present petition is allowed and the petitioner is ordered to be released on interim regular bail w.e.f. 30.10.2025 till 28.11.2025 subject to his furnishing bail bonds/surety bonds to the satisfaction of the learned trial Court/Duty Magistrate/CJM concerned.

The petitioner will surrender before the District Jail, Rupnagar on 29.11.2025 at 10.00 A.M.
