Prayer in the present petition, filed under Section 483 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 is for grant of interim-regular bail to the petitioner, for a limited period of three months, in case arising out of FIR No.129 dated 05.06.2025, under Section 21C/27A/61/85 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as – NDPS Act), registered at Police Station Kalanwali, Police District Dabwali.

Shorn of unnecessary details, the case of the prosecution in brief is that on 05.06.2025, during routine patrolling, the police nabbed the petitioner along with 292 grams 96 milligrams of heroin, which was found from the right pocket of the pants worn by him. Accordingly, the FIR in question was registered against them after completing all the formalities. Now, the petitioner has approached this Court for grant of interim-regular bail for a period of three months.

The learned counsel for the petitioner contended that petitioner’s wife is in an advanced stage of pregnancy with the expected date of delivery being 03.12.2025. The medical record of his wife indicated complications in the kidney of the child in the womb, which necessitated constant medical attention, higher-centre consultations and petitioner’s presence for emotional, financial and logistic support.

On 13.10.2025, learned State counsel was directed to file Status Report, which has been filed today in Court and is taken on record.

Learned State counsel, while referring to the Status Report, submitted that during enquiry, it has been found that petitioner is having three sisters, two of whom are married. Petitioner’s mother and unmarried sister had left his father long time ago. His father, who is a drunkard, lives alone in his house. Presently, wife of the petitioner is living with her one married sister-in-law namely Ramanpreet Kaur wife of Sukhwinder Singh, who takes care of her. Statements of respected members of petitioner’s village were also recorded in this regard. Learned State Counsel further pointed out that as per opinion of the concerned doctor namely Dr. Rohit D Malode, who was attending the wife of the petitioner (Annexure R-4), scan done on 03.10.2025 shows normal scan report of the baby and there was no need for any higher medical consultation. Learned State counsel submitted that as petitioner’s sister namely Ramanpreet Kaur is taking care of his wife, so, the petitioner is not required to be given the concession of interim-

regular bail.

I have heard the learned counsel for the parties and have also gone through the case file.

As per the FIR, recovery of 292 grams 96 milligrams of heroin was effected from the petitioner. The regular bail application of the petitioner is pending adjudication. The ground of advanced pregnancy of wife of the petitioner has been considered, but it is also the admitted position that she is being taken care of by her sister-in-law. As far as her medical condition is concerned, learned State counsel has already placed on record opinion of the concerned doctor, that there is no need of any higher medical consultation.

Accordingly, without having any bearing or expression of opinion on the merits of the case, the present petition is dismissed. Nothing observed herein above shall be construed to be an expression of opinion on the merits of the case. The observations recorded above are only for the purpose of deciding the present petition for interim-regular bail.

Pending application(s), if any, shall stand disposed of along with the present petition.
