1. Prayer made in the present petition for quashing the order dated 24.01.2024, vide which the petitioner was declared as proclaimed person in Complaint No. COMA/6969/2022 titled as ‘Ajayapl Singh vs. Kulwant Singh’

filed under Section 138 of the Negotiable Instruments Act.

2. Learned counsel submits that the petitioner was summoned in a complaint filed under Section 138 of the Negotiable Instruments Act, vide order dated 17.03.2022 and due to his non-appearance, bailable warrants were issued for 29.08.2022, further, non-bailable warrants on 29.08.2023. However, he could not appear as compromise talks were going on between him & the complainant and his mother was undergoing treatment for Cancer at that time, whereupon, on 16.11.2023, proclamation under Section 82 Cr.P.C. was issued and statement of the serving official was recorded on 09.01.2024, wherein it was stated that per
