SANJAY VASHISTH , J. (Oral)

1. By way of this common order, all the aforementioned petitions are being disposed of together, as they arise out of one common FIR.

2. Present petitions have been filed by the petitioners, namely, Gaganjeet Singh @ Gaggi @ Gagandeep Singh, Laddi Singh, Jiven Singh @ Jiwan Singh, and Sehbaz Khan, seeking regular bail in case FIR No. 02 dated 06.01.2025, registered under Sections 109, 115(2), 118(1), 126(2), 351(3), 190, and 191(3) of the BNS (with Sections 117(2) and 238 of the BNS added subsequently) at Police Station Chhajli, District Sangrur.

3. As per the allegations, there are three injured persons in total, namely:

Sukhpal, who sustained seven injuries, two of which are grievous;

(cid:1)

Avtar Singh, who sustained eight injuries, four of which are grievous; and (cid:1)

Gursewak Singh, who sustained four injuries, two of which are grievous.

4. Petitioner-Gaganjeet Singh (in CRM-M-25612-2025) is alleged to have caused one gandassi injury to Sukhpal Singh, which was declared to be simple in nature. Laddi Singh, petitioner (in CRM-M- 37702-2025), is alleged to have given an iron rod blow to Gursewak, resulting in one grievous injury. Jiven Singh @ Jiwan Singh, petitioner (in CRM-M-45696-2025), is attributed with inflicting three injuries with a garrari on Avtar Singh and Gursewak Singh, all of which were opined to be simple in nature. Shehbaz Khan, petitioner (in CRM-M-47291- 2025), is alleged to have inflicted three injuries on Sukhpal with iron rod fitted with garrari, one of which was found to be grievous in nature.

5. On previous date of hearing i.e. 20.08.2025 following order was passed:

“1. Learned State counsel has filed status report dated 19.08.2025 and custody certificate, in both the cases, in the Court today and the same are taken on record.

2. It is informed that charges were framed on 14.05.2025 and date fixed before the trial Court for recording of the statement of the witnesses is 30.08.2025.

3. List again on 29.09.2025.

4. Prosecution and trial Court is directed to record the statement of the injured, eye-witnesses at the first instance, before the next date of hearing fixed by this Court.

5. A photocopy of this order be placed on the file of other connected case. ”

6. In compliance with the directions issued by this Court, a report has been forwarded by the learned Additional District and Sessions Judge, Sangrur, vide letter No. 452 dated 22.09.2025. As per the said report, there were five injured/eye-witnesses in total, out of whom two have been given up by the prosecution. The remaining three witnesses, i.e., the complainant/injured/eye-witnesses, have already been examined. 7. Learned counsel for the petitioner(s) submits that petitioners are in custody for a period of more than nine months. It is contended that the investigation stands concluded and the challan has already been presented before the trial Court. It is further submitted that out of the total number of prosecution witnesses, the material witnesses, including the injured/eye-witnesses, have already been examined.
