1. The petitioners have filed the present writ petition under Article

226/227 of the Constitution of India with the following prayers:-

To issue a writ in the nature of Mandamus directing the respondents to grant the petitioners minimum of the Pay Scale i.e. Basic Pay + Dearness Allowance, in the Pay Band of Rs. 10300-34800+ 4200 Grade Pay along with DA (as revised from time to time), at par with their regular counterparts, instead of Fixed Consolidated Salary, from the date(s) of their initial contractual appointment(s) and its consequential arrears along with interest @18% per annum in ratio of law as laid down by the Hon'ble Supreme Court of India in State of Punjab vs. Jagjit Singh 2016 SCT 641, as followed by the this Hon'ble Court vide its Common Judgment 25.11.2024 (P-4) [duly upheld by the Division Bench of this Hon'ble Court vide Judgment dated 23.07.2025 (P-9) as well as by the Hon'ble Supreme Court of India vide its Judgment dated 19.09.2025 (P-12), and particularly, in view of the fact that the similar benefit stood already granted to the Multipurpose Health Workers (Females) working on Contract Basic in the National Health Mission, Punjab, like the Petitioner, by way of Office Orders as passed Respondent No. 4 in compliance of the said Judgment dated 25.11.2024 (P-4).

It is further respectfully prayed that the petitioners be permitted to file the legible photo/typed copies of Annexures P-1 to P-12 and further be exempted from filing the certified copies as the same are not readily available with the Petitioners, in the interest of justice.

Learned counsel for the petitioners submits that the petitioners have already served a legal notice dated 16.09.2025 (Annexure P-10) on the official respondents and they shall be satisfied in case, appropriate directions are issued to the respondents to look into legal notice dated 16.09.2025 (Annexure P-10), in a time bound manner.

3. Notice of motion.

On the asking of the Court, Mr. Charanpreet Singh, AAG, Punjab, who is present in the Court, accepts notice on behalf of the official respondents and Mr. Anil Sharma, Advocate accepts notice on behalf of respondent No.4 and they have no serious objection to the prayer made by learned counsel for the petitioners, at this stage.

5. I have heard learned counsel for the parties and perused the record carefully.

6. At this stage, it would be appropriate to direct the respondent No.4 to decide the legal notice dated 16.09.2025 (Annexure P-10) in view of the judgment passed by Hon’ble Supreme Court in the matter of “State of Punjab Vs. Jagjit Singh reported as 2016 (4) SCT 641” within a period of four months from the date of receipt of certified copy of this order.

Needless to observe that the respondent No.4 shall pass a speaking and well reasoned order in the light of the above referred judgment as well as relevant rules/instructions and in case, petitioners are found entitled to any consequential benefits, the same shall also be released to them, without any further delay, along with reasonable rate of interest.
