The instant contempt petition has been preferred under Sections

11 & 12 of the Contempt of Courts Act, 1971, alleging disobedience of order dated 11.01.2024 (Annexure P-1), passed in CWP-21099-2023.

2. The aforesaid writ petition was disposed of vide order dated

11.01.2024:

“Learned State counsel submits that the petitioner’s name has been recommended for appointment on the post of Craft Instructor Draughtsman (Civil), category no.44 pursuant to advertisement no.12 of 2019, vide letter dated 6.10.2022. Therefore, the petition has been rendered infructuous.

Disposed of as such.”

3. It has been averred that vide order dated 05.09.2024, the candidature of the petitioner was cancelled. It is the case of the petitioner that under the circumstances, the respondents committed willful disobedience of order dated 11.01.2024, passed in CWP-21099-2023.

Compliance report by way of affidavit of Director, Department of Skill Development and Industrial Training, Haryana, was filed, wherein it has been averred that after recommendation of the petitioner by the Haryana Staff Selection Commission for appointment to the post of Craft Instructor (Draughtsman Civil Instructor-Practical), the candidates’ documents were to be verified by the Department at its own level. It was further averred that a note had duly been given in the communication received from the Haryana Staff Selection Commission, through which the name of the petitioner was recommended:-

“The selected candidates have not been medically examined and no special enquiry into their antecedent has been made. It has been observed that candidate are submitted certificate regarding their experience form Departments/Institutions/ Local Workshops/ Industries/ Private shops and commission has no method to authenticate the veracity of their certificate. Therefore you may please check the documents thoroughly for their genuineness and in case any candidate is found to have submitted their documents particularly experience certificate not fulfilling the stipulated condition of eligibility or found incorrect, his case may be reported to HSSC with recommendation for his continuation on the post or rejection. The documents pertaining to their Essential Qualification, Age, Caste/ Category, Universities, Socio-Economic criteria and Experience as claimed by them in the application form may please be got Checked/Verified from issuing authorities, before they are allowed to join their duty.”

It has further been averred that the documents of the recommended candidates were forwarded to the Department by the Haryana Staff Selection Commission and the same were subsequently sent to the Documents Verification Committee. The candidates were also to appear before the Committee for verification and to submit their supporting documents. The Committee found that the petitioner’s documents were not in accordance with the advertisement. Although the petitioner appeared before the Committee, he did not submit any relevant supporting documents. Thereafter, a Physical Verification Committee was constituted for checking the authenticity of the experience certificate, and upon visiting the company’s address, no such company was found. It has been averred that the petitioner was given four opportunities to provide the requisite documents, but he failed to do so, as a result of which his candidature was cancelled.

6. Learned Deputy Advocate General, Haryana, submits that under the circumstances, no willful disobedience of order dated 11.01.2024 (Annexure P-1) has been committed.
