1. By way of this common order, this Court intend to dispose of abovesaid two petitions as they have arisen out of the same FIR.

2. Petitioners have approached this Court by way of present petitions praying for granting them regular bail in case FIR No.383 dated 25.10.2024, under Sections 204, 205, 318(2), 318(4), 319 of BNS (Sections 61(2) of BNS added lateron), registered at Police Station Adampur, District Hisar.

Succinctly, the facts of the present case are that the police party, while on patrolling on 25.10.2024, received a secret information to the effect that some boys are travelling in two cars one white Corolla car bearing registration No.HR-26-BF-9774 and Swift desire bearing registration No.HR-32-F-3834. It was informed that they trapped innocent persons by alluring them with a promise to give three times of fake/duplicate currency in lieu of real currency. On receiving the information, the police reached the place as disclosed. In swift car, 02 persons were found, namely, Ajay and Raman (petitioner in CRM-M- 47401-2025), whereas in Corolla car, 05 persons were found, namely, Amit, Ajay, Ramanand, Azad and Sanjay. Search of the car was conducted, from which 27 bundles of notes were recovered and each bundle was checked. In every bundle, currency notes of Rs.500 of ‘Children Bank of India’ was found. On recovery of the same, the FIR was registered and all 07 accused were arrested. During investigation, complicity of petitioner-Devender @ Bittu (petitioner in CRM-M-47401- 2025) was surfaced and thus, he was also arrayed as an accused in the present case. Resultantly, he was arrested on 14.12.2024. On completion of investigation, challan was presented and on framing of charges, trial commenced. Both the petitioners approached the learned Additional Sessions Judge, Hisar for grant of bail. However, after hearing both the sides and finding no merit in the same, the learned Additional Sessions Judge, Hisar declined their bail applications vide orders dated 18.02.2025 and 20.12.2024, respectively. Hence being aggrieved, petitioner-Devender @ Bittu approached this Court earlier by way of filing of CRM-M-11014- 2025 but the same was dismissed as not pressed vide order dated

04.03.2025. Hence, he is before this Court by way of filing of present second petition. Petitioner-Raman Kumar approached this Court twice by way of filing of CRM-M-1569-2025 and CRM-M-13795-2025, however, the same were declined by this Court vide order dated 20.01.2025 and 25.03.2025, respectively, hence, he is also before this Court praying for the grant of bail by way of filing the present third petition.

4. Learned counsel for the petitioners have contended that the petitioners have been falsely implicated in the present case. It has been submitted that there is no allegation regarding counterfeit currency, however, they have been implicated in this case only on the allegation that the petitioners were in the custody of some duplicate currency. It is submitted that the currency notes beard endorsement ‘Children Bank of India’ and thus, intention on the part of the petitioners to cheat or to commit any fraud with the persons, could not be drawn. They submit that petitioner-Raman Kumar has no criminal antecedents, however, petitioner- Devender @ Bittu is involved in 01 more case, however, he is on bail in that case. They, thus, submit that in the overall facts and circumstances, the petitioners deserve to be granted bail.
